There's nothing like a crisis to rally the troops, particularly if those troops have been forced to watch the action from afar. Just ask Akin Gump, K&L Gates and Mayer Brown, all of which have set up crisis groups to help their clients deal with the dire state of the financial markets (see story).

The major roles on ongoing banking failures, nationalisations and all round state interventions have been snapped up by a large proportion of the Transatlantic Elite. With what was once known as the credit crunch escalating into something distinctly more epoch defining, it's not surprising that other firms want a piece of the action.

Akin Gump, K&L Gates and Mayer Brown could be clutching at straws though. Clients of the firms who are confused by market activity are being offered access to analyses, news round ups and general counselling, in what must surely go under the elusive "value added services" umbrella.

These 'crisis units' will clearly never rival the place-in-history work being done by the likes of Sullivan & Cromwell chairman Rodgin Cohen, but at least they might create a bit of work for some otherwise thumb-twiddling lawyers.

Mayer Brown has set up a taskforce of lawyers in its financial transactions, restructuring, employment, pensions, tax, real estate, regulatory and banking litigation practices, presumably to man the phones on its hotline.

Could this be the start of the era of law firm call centres? If they utilise lawyer time they will beat redundancy consultations anyway. Just ask Cobbetts (see story).

Pillsbury broadens horizons

For a firm lacking in a wide network of overseas offices, a surprising amount of Pillsbury Winthrop's clients are international. As the firm's executive vice chairman Steve Huttler says: "Around one third of our work involves a cross-border element".

That proportion just got significantly bigger, thanks to its acquisition of 22 lawyers from struggling firm Thelen. The group includes a bunch of lawyers in Washington, DC, San Francisco and Shanghai with the latter group headed by a lawyer well known to Pillsbury: Tom Shoesmith.

Shoesmith, who becomes the new managing partner of Pillsbury's Shanghai office, is a Californian lawyer with a longstanding working relationship with his new firm's Silicon Valley office. Many times, Shoesmith has been on the other side of the table working on the same deals - but not always for the same firm. Over the years he has worked at Baker & McKenzie, then Cooley Godward, Paul Hastings, Thelen and now Pillsbury.

Pillsbury is keen to spin its latest hires as a significant boost to its Chinese emerging company and foreign direct investment practices. We're sure Shoesmith & Co will do just fine and be admirable additions to the Pillsbury brand, but the firm does have a bit of a history of bolt-ons and mergers that have been less than silky to bed down.

Think DC-based Cushman Darby & Cushman in 1996, Winthrop Stimson Putnam & Roberts in New York in 2001. And who could forget Shaw Pittman in 2005?

Slaughter late than never

It's been a long time coming but it's happened at last: Slaughter and May has emerged in the Wall St chaos, advising in the Bradford and Bingley rescue (see story).

As we have noted more than once since the Lehman collapse, Slaughters has hitherto been mysteriously absent from the host of elite firms involved.

Lehman? Merrill? Linklaters and Weil Gotshal starred.

AIG? Sullivan & Cromwell. Lloyds-HBOS? Er, Links again.

The US government's $70bn cash lifeline? Cravath and Davis Polk. The Barclays Lehman bid? Clifford Chance. And the JP Morgan-WaMu takeover? Simpson Thacher and Sullivan.

The Sweet Sixteen of Transatlantic firms have also enjoyed a host of other, smaller roles on the transactions, making Slaughters' absence from even the junior player list all the more mysterious. But advising the government on a GBP50bn part nationalisation of one of the country's best-known lenders is at least the firm turning up late in style.

Heller Ehrman up for grabs

Some usual suspects are circling Heller Ehrman as the fire sale of its various practices kicked off in earnest after news of the West Coast firm's dissolution.

Baker & McKenzie and Orrick Herrington & Sutcliffe were among the key beneficiaries of Coudert Brothers' demise three years ago. And both are interested in various bits of Heller (see story).

Bakers turned down a full-scale merger with Heller just last month, mainly due to its lack of interest in the firm's London or Asia offices, but it could emerge as a favourite for the US offices if it is willing to take over liability for the leases.

Winston & Strawn has popped up again as another contender, as it was with Coudert, but it is likely to try and cherry pick its favourite bits.

But one firm is conspicuously and mysteriously missing from the fray. Where is DLA Piper? It was happy to take huge swathes of Coudert. Yet it is not even rumoured to be interested in Heller. Come on Big Nige, what's wrong? There are deals to be done.

Yes, in his latest manifestation Allen & Overy managing partner David Morley has managed to bag himself a seat at Boris Johnson's International Business Advisory Council for London, the mayor's group dedicated to maintaining London's position as world business centre (see story).

Despite Morley's relocation to New York for three months from October.

Short of developing some sort of teleportation machine, Morley will have to train a squad of body doubles to see him through all his high-powered roles. Slap a grin, a sharp suit and a slick haircut on a handsome senior associate and you have David Morley MkII.

But Morley is not the only managing partner to be popping up all over.

Rodgin Cohen, Sullivan & Cromwell's chairman, totem and the King of Manhattan, has seemingly developed the power of omnipresence during the financial crisis, advising in, well, almost all of the big deals that followed the Wall St turmoil.

In the latest, his firm is advising Goldman Sachs on Berkshire Hathaway's $5bn cash injection.

Conflicts of interest

It is a little advertised fact that when Barclays swooped on Lehman for $1.35bn worth of assets, Sullivan & Cromwell partners Jay Clayton in New York and Hydee Feldstein in Los Angeles stepped up as co-counsel with Cleary Gottlieb.

Sullivan's role on the deal came just days after it had been advising Lehman on its options prior to its filing for Chapter 11 bankruptcy protection.

As one New York partner at a rival firm put it, "Sullivan & Cromwell have certainly had a complex life of late regarding conflicts of interest." True.

And none of the partners at the firm have had a more "complex" time recently than its chairman, Rodgin Cohen.

Cohen, simply put, has been everywhere. This week he popped up with partner John Mead on Warren Buffett's $5bn stake in Goldman Sachs (see story).

Last week, Goldman also got the benefit of Cohen's decades of experience when it began its transformation into a bank holding company.

And Cohen was at the helm for AIG's $85bn bailout by the Federal Reserve; for mortgage giant Fannie Mae's effective nationalisation; and for the board of directors at Bear Stearns in its takeover by JPMorgan Chase.

It's a phenomenal year. And it got The Lawyer thinking that it must make steering conflicts of interest a significant challenge in itself.

"There are very few conflicts that can't be waived," Cohen told us yesterday. "If you're up front with clients, they tend to be extremely understanding. Clients come to us because they want our services."

In the Barclays/Lehman case, this was particularly true.

"It was in their interests and indeed everybody's interests, not least the thousands of employees, to get the deal done," added Cohen.

And as for the personal effect of the past few weeks on the mighty Rodge, we thought it was worth asking how he was holding up. "Sometimes I wonder," he admitted.

Charlie Geffen's victory in the Ashurst senior partner election is further good news for the firm's lawyers in Asia.

Spirits already raised by outgoing senior partner Geoffrey Green's move to Hong Kong to lead a push on China, the rest of the firm's eastern talent will be pleased to hear that Geffen's priority is expansion there too - read Geffen's first interview since taking on the new job.

But for the rest of the partnership, the decision was a simple barometer of feeling about the future.

As one Ashurst partner told The Lawyer, "Charlie's gung-ho, energetic, outward-looking and comes up with lots of ideas" (see story).

The alternative, by contrast, is litigation partner Ed Sparrow, described by the same source as being "good at reconciling competing interests... seen as a candidate for those who think we'll be in for a choppy ride."

The choice of a buccaneer over a slow and steady hand at the tiller shows a confidence among the partnership that, downturn or no downturn, Ashurst remains a firm in expansive, not defensive mode.

Both of which observations lead rather neatly to a little crystal ball gazing we've been enjoying with Ashurst and other firms in its silver circle peer group. Expansion in Asia? A boost in London? The New York State bankruptcy court was packed to bursting point last Friday (19 September) as the Manhattan legal community turned out to hear whether Barclays should be free to acquire Lehman Brother's investment banking arm.

Among the big names we saw in court was Weil Gotshal & Manges bankruptcy heavyweight Harvey Miller, who was there to defend Lehman from the raft of lawyers representing creditors left stranded by the bank's fall.

Linklaters, which undoubtedly stole a march on its UK rivals by winning a key role advising Lehman's administrator, PricewaterhouseCoopers (PwC), was also there. A team led by New York litigator Larry Byrne turned up to court for PwC.

Miller, Byrne and co were all there to hear - or reveal - details surrounding the fall of Lehman. The updated deal struck by British bank Barclays caused a stir of recognition among the multitude of lawyers present in court and provided even more evidence of the chaos the global markets are now suffering.

In the middle of last week, Barclays had agreed to acquire Lehman's investment arm for $1.75bn while absorbing $72bn in securities liabilities and $68bn in trading liabilities.

By Friday, Lehman's counsel - Weil partner Lori Fife - outlined an amended deal that included a dramatic reduction in those liabilities. Now, the court heard, Barclays was to absorb $47.4bn in securities liabilities and $45.5bn in trading liabilities.

As well as such a dramatic decrease in value, the packed court also heard how the deal had expanded to include Lehman Brothers Canada, Lehman Brothers Sudamerica, Lehman Brothers Uruguay and the bank's private investment management business.

As Fife told the court, this was the result of an unprecedented week on Wall Street. With this week seeing private equity houses Bain Capital and Hellman & Friedman, advised by Ropes & Gray and Cleary Gottlieb Steen & Hamilton respectively, lining up to acquire Lehman's asset management arm while Skadden client Nomura has bought its Asian business, this was no understatement.

In the unlikely event you haven't noticed that the economy has been somewhat, well, turbulent recently, a new indicator emerged today: lay-offs at Freshfields (see story).

OK, so lay-offs in this downturn are hardly a new thing. And yes, that's only four lawyers from a firm of 2187 of them. And yes, they're all in real estate.

But the Freshfields redundancies are the first in the magic circle, and a sign that not even that fabled group is immune from the downturn.

Still, it's worse for some than others. While Freshfields is laying off these lawyers after trying and failing to find them new roles overseas or seconded around the firm, Linklaters has scarcely lawyers enough, with some 20 partners dedicated to the Lehman Brothers job, one of the biggest senior legal teams seen on an insolvency this decade (see story).

And while many firms fret, others are making love. Well, they ought to be.

Doesn't Monday seem a long time ago now? Kicking off with the collapse of Lehman, the speed of change among the world's financial institutions has made this week feel as long as the faces on Manhattan's Upper East Side.

But as today's Wall St woes blog post notes, it's not just financial institutions that are feeling the heat.

Lehman's demise, the acquisition of Merrill Lynch and the effective nationalisation of AIG has bestowed several firms lucrative mandates, the latest among them Milbank Tweed, but left others bereft of once lucrative clients.

Among the latter group is Cadwalader Wickersham & Taft, which with Lehman's fall following close behind that of another big client, Bear Stearns, will be keenly considering new sources of work; and Shearman & Sterling, which has just waved goodbye to another big client, Merrill.

Still, there is some good news. Not only is Latham & Watkins surprisingly sanguine about it all, but Lehman's in-house legal team is enjoying a temporary reprieve after an assurance from PricewaterhouseCooper that not only are the lawyers are still in demand, but they'll still get paid this month too (see story).

Oh, and amid all the chaos, Bird & Bird has given an ever so timely boost to its corporate and litigation teams via a merger with 30-partner Lane & Partners (see story). Still, roll on the weekend.

Heller in crisis

Could Heller Ehrman be facing the prospect of dissolution? The wires are buzzing on the topic as the rate of partners deserting the firm accelerates.

On Sunday the West Coast firm’s merger talks with Mayer Brown collapsed. It is understood that one of the reasons for the talks’ failure was the imminent departure of a group of 15 IP partners to Covington & Burling (16 September).

The exit of the IP team, a group which included well-known stars Robert Haslam and patent litigator Robert Fram, also highlighted another of Heller’s most pressing problems: it had transformed itself from a leading litigation and IP specialist into a hunting ground from which rivals could cherry pick.

“It’s a total feeding frenzy,” says one legal market recruitment consultant. “There are groups breaking off here and there while other firms are talking to individuals and groups.”

The average partner capital at Heller is between $200,000 and $400,000. Several of the partners that have left the firm during the course of this year are understood to be still waiting for their money.

Meanwhile, the exits look set to continue, with the high-profile former Venture Law Group, which contains around 30 to 40 partners in Silicon Valley, believed to be talking to at least five firms: Cooley Godward, Wilson Sonsini, Gunderson Dettmer; Morrison & Foerster and Morgan Lewis.

According to Harry Rubin, the former co-chair of the IP transactions group at Heller, who joined Ropes & Gray in March 2007, the firm has two options.

“Either they radically restructure and retrench to focus on the few geographical locations and practice areas where they are the strongest, and they certainly have enough talented people to do that,” says Rubin. “Or they dissolve. There’s really nothing else left.”

Heller chairman Matt Larrabee is thought to have told his colleagues last week that he had now given up on his attempt to find a merger partner and the firm was preparing to “go it alone”.

Many outside the firm have interpreted this as a sign that the firm is, in fact, preparing to dissolve in an orderly fashion.

Larrabee did not return calls for comment.

Tales of the unexpected

The world's going mad. Half the City has nothing to do while the rest is scrambling to advise Lehman's swaps counterparties.

And amongst all the brouhaha over HBOS, AIG and Lehman, there are a couple of other astonishing stories which might have escaped your attention.

Here's one. Shearman & Sterling, fresh from helping prized client Merrill Lynch walk into the arms of Bank of America, just lost its Munich office head and another partner to A&O (see story)

Now, we reckon that makes 16 partner departures in Germany in the last year alone. That's not looking too rosy.

Meanwhile, over at Heller, the collapse of merger talks with Mayer Brown has seen 15 more partners leave in the last couple of days alone (see story). We keep losing count of partner departures from Heller this year, but we make it around 40, at least.

Comparisons with the banking market? Well, neither Shearman nor Heller has had to write down billions on dodgy derivatives trades, and both are on a perfectly sound financial footing.

But you can still draw one parallel with what is going on in Wall Street. It's all about confidence, or more precisely, the lack of it.

Shearman's Germans seem to have lost it, hence A&O's opportunistic raid. And it's also in short supply at Heller, too.

Lehman lawyers: safe for now?

The sight of Lehman Brothers staff walking out of Canary Wharf with cardboard boxes full of possessions has been one of the defining images of the credit crunch.

But it is unlikely many of the stricken bank's legal team were among them. They were still in the office, working on the final trades of the previous week.

In fact, Lehman's lawyers are likely to be some of its busiest staff over the coming weeks. Administrators from PriceWaterhouseCoopers have already moved in and have begun asking for documents and reports.

Despite this, the axe is hovering ominously over all 100 or so members of the Lehman in-house legal team (see story)

The problem is that PWC has not offered them new jobs and their current employer, Lehman, will soon cease to exist.

As one legal recruiter commented: "They are stuck in limbo. They don't know if they are going to get paid or not this week."

Little wonder then that recruitment firms have seen Lehman CVs arriving in droves. And with lawyers from Merrill Lynch adding to the pile, now would seem like a good time for City firms to bolster their banking practices with a few opportunistic hires.

Lehman’s spectacular collapse, Bank of America’s stunning acquisition of Merrill Lynch and Fannie and Freddie’s government bailout were the only topics of conversation on Wall Street yesterday (15 September).

And while the trickle-down effect for the law firms will take weeks and months to appear, a picture is already emerging of the go-to US heavyweight firms that have won more than one mandate on these historic deals. 

Wachtell Lipton Rosen & Katz is right up there, with Ed Herlihy already jostling Sullivan & Cromwell’s Rodgin Cohen for US lawyer of the year.

Wachtell is advising both the US Treasury on the mortgage giants’ rescue and Bank of America on Merrill, while Cohen at Sullivan advised Fannie Mae, as well as having previously advised the Bear Stearns board on its takeover by JP Morgan.

Cravath Swaine & Moore is also a contender. Partner Bob Joffe is advising the independent directors of Fannie Mae, while his colleague Rob Kiessling is representing JP Morgan Chase as administrative and collateral agent for the $70bn liquidity facility being launched in the wake Lehman’s collapse.

Davis Polk & Wardwell also popped up in numerous places, with partner Donald Bernstein advising Citigroup on its participation in the emergency fund and the firm taking a lead role advising Freddie Mac.

Elsewhere, it’s good news for longstanding Merrill adviser Shearman & Sterling, where the two Johns - Madden and Marzulli - are advising the bank on its sale and Weil Gotshal & Manges veteran Harvey Miller, who was instructed to on the Chapter 11 filing.

As usual, in the short term at least, top lawyers are doing fine out of the mess. We'll keep you posted.

Lehman Bros: "Seminal days"

Oh, the ups and downs of finance lawyers. Three months ago Linklaters' banking group was filled with gloom after JPMorgan dumped it from every mandate you've ever heard of (revealed by The Lawyer, 23 June).

But this afternoon the group are the kings of the City, having captured the mandate to advise on the UK end of the administration of Lehman (see story).

On the US side - yes, you guessed it - bankruptcy mavens Weil Gotshal are involved on the Chapter 11 filing.

The fall of Lehman Brothers comes just six months after the bank extended its UK panel to include Simmons & Simmons. Other panel firms watching this closely include A&O, Lovells, Ashurst, Freshfields, Linklaters and Weil.

One partner at a City firm said: "These are uncertain times we're living in - I think you get certain seminal days in your career, like 9/11 or the Big Bang. Today in shock terms is huge, seeing a bank like Lehman go under."

"When peering into the future, it's sometimes instructive to look at the past," says Allen & Overy chief David Morley - and we agree.

Sparrow v Geffen

Ashurst has kicked off the contest for the top job at the firm, with senior partner Geoffrey Green stepping down to make way for either private equity chief Charlie Geffen or litigation guru Ed Sparrow (see story).

Both Geffen and Sparrow are Ashurst diehards, and both boast
impeccable CVs. Sparrow, however, was already a partner a year before young Geffen even joined as a trainee in 1982.

Age discrimination concerns aside, this could give Sparrow an advantage: partners may wonder whether they want to be led by a combination of managing partner Bromwich and Geffen - both spring chickens when compared to Green.

But partners will also wonder whether they want the firm, built on the back of corporate and private equity, run by a litigator pairing of Bromwich and Sparrow.

And with a downturn/recession/Armageddon looming, Sparrow could be more valuable as a fee-earner, helping out old contacts at the FSA and various financial institutions.

The Lawyer has been lording it up in New York this week: literally.

On Tuesday (9 September), Gibson Dunn & Crutcher formally launched a new international arbitration group. Okay, marketing efforts such as this are not usually news, but this one was a little bit different.

The firm is particularly proud of its new team, not least because it features a string of recent hires from top UK firms such as Herbert Smith, Freshfields Bruckhaus Deringer and Clifford Chance (see story).

Consequently, Gibson Dunn threw a party at the glitzy Audi Forum on Fifth Avenue. True, a car showroom doesn't sound glitzy, but trust us, it is (or at least the motors were).

One of the novel features of the evening was the man who could be spotted weaving his way around the gleaming Audi R8. It was none other than former British Prime Minister Tony Blair's one-time flatmate, Lord Falconer of Thoroton.

The Lawyer and Falconer go way back. As far back as June, in fact. That was when the former Lord Chancellor hosted the glitziest night of the year in the British legal calendar, The Lawyer Awards.

This time Charlie, as he prefers to be known, was on the other side of the pond making his first trip to New York since joining Gibson Dunn in July. In a room that positively buzzed with bonhomie, Charlie was on good form. As was, incidentally, former Herbies man Larry Shore.

In his speech, Shore revealed that it had been a bit of a struggle convincing his slightly more conservative west coast Gibson Dunn partners that the invitations to the launch party should not only go to colleagues and clients, but competitors. But as he put it, appreciating the needs of all sides is basically what arbitration is all about.

At least the champagne-quaffing hacks from The Lawyer appreciated it, Larry.

Amidst all the brouhaha yesterday about women making partner in record numbers, another story may have escaped your attention.

As revealed on TheLawyer.com yesterday, US West Coast giant Heller Ehrman lost yet another partner - this time the head of its Beijing office, Joseph Cha. See story.

Cha is at least the 50th partner to have left the firm since the beginning of 2007, some seven of whom have just joined West Coast rival Sheppard Mullin Richter & Hampton. (See story.)

All is not well, to say the least.

As The Lawyer in New York has been noting, Heller has been in a vulnerable position for several months.

Since then Baker & McKenzie - never averse to a spot of opportunistic acquisitiveness - has taken a look at Heller and turned its nose up.

The reality is that by the time Baker & McKenzie popped up as Heller's latest suitor, there was not enough left on the table to make the pain of a deal worthwhile. Heller, simply put, has lost too much potential over the past year.

One must question why Mayer Brown actually wants a domestic US deal with Heller. Mayer Brown ought to have enough on its plate right now, what with the Johnson Stokes merger in Asia, the internal restructure and a whole lot of tricky politics.

The perception in the US is that Heller is no longer in the first tier. The firm's chief Matt Larrabee may balk at this, but Heller's brand has taken a heck of a battering.

It's still relatively strong in San Francisco, but the momentum generated by letting some of the firm's unproductive people go has resulted in it losing some of its biggest rainmakers.

Looks like Heller will have to make a pretty persuasive pitch if it wants to find itself a deal. And let's hope the firm's London office - launched only last year - is part of it.

It might be lacking a bit in the way of global coverage, but when it comes to domestic dramas Wachtell Lipton Rosen & Katz can't be beaten.

At least, that's true as far as US Treasury Secretary Hank Paulson is concerned. Paulson has turned to Wachtell corporate big cheese Ed Herlihy and his restructuring buddy Harold Novikoff to advise him on how to sort out the astounding mess that is Fannie Mae and Freddie Mac (see story).

Understandably, the biggest drama so far to result from the unfolding credit crunch - and there have been a few - has seen a long line of the US's top lawyers also wheeled in to help clients in their moments of need.

The latest to get in on the act is Allen & Overy, the first of the UK magic circle to secure itself a role. A&O New York partner Dan Cunningham is advising longtime client the International Swaps and Derivatives Association (ISDA) on the aftermath of the government's bailout. Part of ISDA's response came yesterday (Monday 8 September), when it announced a new protocol to facilitate settlement of credit derivative trades involving Fannie Mae and Freddie Mac.

This is likely to be a weighty and remunerative matter for A&O. It's less clear how big the bills will be for the firms advising Fannie Mae and Freddie Mac (respectively Sullivan & Cromwell and Latham & Watkins, and Davis Polk and Covington & Burling).

As one New York partner at a rival firm put it, "It's a big assignment, true, but there's not much to do. They've just been marched in and the Treasury's said, 'sign here'."

Julius was defending his firm, which has got caught up
in a row between trustees and board members of the
Jewish National Fund (JNF) and its former chief executive
Simon Winters.

after this case Julius may have replaced Ms Shackleton at
the top of the most-mentioned list.

Eversheds sheds Norwich

Eversheds' decision to take an axe to its Norwich business
has been a long time coming.

As we report today, a total number of 33 lawyers firmwide - plus an
as yet unspecified number of staff - are facing redundancy,
with everyone else being transferred to the firm's Cambridge
office.

Eversheds is blaming current market conditions, which is
fair enough. But its line that the Cambridge and Norwich
offices are 'merging'? Codswallop.

Telling a bunch of lawyers they have to go and work in
Cambridge does not constitute an office merger. No,
Eversheds is closing down an entire office - and one
which played an important part in the firm's history.
The heritage Norwich practice of Daynes Hill & Perks
was a key player in the creation of the Eversheds network
back in the 1990s.

And there's something else which doesn't quite wash. The
closure is not just about the credit crunch; it may have
provided the current impetus for the decision, but you'd
have to be catastrophically affected to shut down an
entire office.

Rather, for the last few years Eversheds' Norwich base has
occupied the unloved position of a back office with a
decreasing number of champions within the firm.

Its demise was inevitable. This was not done on the hoof;
it was strategic.

Bear necessities

We at The Lawyer are occasionally baffled by the American use of middle initials. But this is one case where those initials are warranted.

So, just to be clear, the Kenneth A. Kopelman, just hired by Bingham (see story) is no relation to Kramer Levin securities partner, Kenneth P. Kopelman.

Bingham has just become the latest firm to benefit from the collapse of Bear Stearns. As we report, the firm has just hired two former Bear Stearns lawyers to strengthen its international securities practice.

Kopelman, formerly legal head of Bear's fixed-income and derivatives group, and the bank's managing director of legal Gerald Russello are joining Bingham in New York as partner and of counsel respectively.

Though there's always an element of opportunism with any hire - and a failed bank certainly presents an opportunity for some - Bingham's links with this pair go way back. Bingham partner Neal Sullivan, co-head of securities group, has known Russello since the former Bear lawyer was in the enforcement side of the SEC.

For his part, Kopelman is a name on Wall Street and is widely considered one of the leading derivatives specialists in New York.

Sullivan told The Lawyer his firm had been hunting for a derivatives lawyer of Kopelman's calibre for two years.

"To be able to hire someone who has the experience and who has done the deals is a real asset to the firm," said Sullivan.

Often it's easier to hire junior lawyers and train them up. As Bingham and its rivals know, to get your hands on someone of Kopelman's status is rare indeed. In London, Bingham has its fair share of securities lawyers. In New York there was a derivatives-shaped hole waiting for someone to round out its securities practice.

Thanks to Bear, it's just been filled.

DLA Piper, Freshfields, SJ Berwin and
Bristol's Burges Salmon all feel the same way, which is
the reason that they have got together to come up with
a scheme for assessing just how much CO2 they are actually
responsible for.

The code, designed by the Legal Sector Alliance to show
firms how to be more green, is the brainchild of newly-re-elected
DLA boss Nigel Knowles, who says he "had a call to arms in
October where we got people from about 30 law firms round for
breakfast in our offices to say 'why don't we
take the lead here?'"

Some 18 firms including DLA, A&O, Eversheds, Herbies,
Lovells, Linklaters and the Law Society have all pledged
to reveal their carbon shoe size by Christmas, but cautious
types shouldn't worry: using the scheme doesn't
mean that you'll have to reveal yours too.

"Even if you don't agree that climate change
is an issue, just doing things better and more efficiently
is a cost saver," Knowles added. "It's an absolute
no-brainer."

of the transfer window last night, but the man of the match
was Hammonds, due to its valuable tie-up with Manchester City.

First up, the firm represented Man City on its GBP200m sale
to Abu Dhabi United Group, a consortium led by Arab businessman
Dr Sulaiman al-Fahim, who said yesterday that the group is "looking
to make the same kind of impact at Manchester City that has
happened at Chelsea."

Second, Hammonds also represented Man City on its record-breaking
(and Chelsea-beating) GBP34.2m signing of Brazil and Real Madrid
forward Robinho.

Though it began last year, the Man City relationship has been a
lucrative one for Hammonds, which has already acted for it
in a pair of deals including, er, sacking former England
manager Sven Goran Erikson.

Windy days for Heller

They say it’s an ill wind that blows nobody any good.

Currently there are gales of Gustav proportions circling Heller Ehrman. And all around, other firms are benefiting.

But it would be hard to find a single firm that has gained as much as
California’s Sheppard Mullin Richter & Hampton. Today (2 September) The Lawyer exclusively reveals that the firm has taken seven Heller partners since January this year, the latest being Silicon Valley IP partner Hal Milstein (See story).

Clearly, Heller’s woes have had a big hand in Sheppard Mullin’s recruiting policy. But the acquisitive firm is also cannily leveraging off the old boy (and girl) network. With the exception of New York finance and bankruptcy duo, Carren Shulman and Russell Reid, these partner hires all arrived as individuals rather than as part of a team.

The lure? A culture at Sheppard Mullin that the firm’s management could not only say was more amenable than at Heller, but could also wheel out a growing list of their former work colleagues to convince them.

It’s a powerful argument.

Feeling overworked? Underpaid? Out of the loop?

Not as much as your support staff are.

Yes, The Lawyer's first employee engagement survey, revealed
today, shows support staff to be a truly dissatisfied bunch - and
the credit crunch has got nothing to do with it (see story http://www.thelawyer.com/cgi-bin/item.cgi?id=134316).

Almost two thirds of them don't feel their roles are valued.

Not even one in five feels there are good opportunities for promotion.

And only a quarter feel they are given clear messages about their career potential.

But it's not just the support staff. The malaise affects the professionals too, with less than
half satisfied with their salaries or convinced that partnership is
achievable; and only just over a quarter believing the firm provides
a good alternative to partnership.

All of which should have HR teams scratching their heads and
wondering just what to do about the terrible morale.

That is, if they feel it's worth it. Which being in a support
team, they just might not. Managing partners, over to you.
