On a sunny Monday at the end of June, associates could be forgiven if their attention drifted from due diligence to holidays.

Especially those at Addleshaw Goddard, whose retreat has been cancelled while partners enjoy la fete with their counterparts in Paris. See story.

Managing partner Mark Jones told The Lawyer that the partners "had competing priorities about how to spend our discretionary spend" (sic).

But with the Paris Le Grand hotel where they stayed just a stone's throw from the city's Les Grands Magasins department store district, there may have been competing priorities about how to spend their extra 44 grand too.

Partners at DLA Piper and Hammonds, meanwhile, are slaving in the galleys at conferences on cruise liners. Hammonds sources were vague on the details, though The Lawyer understands that partners will brave the stormy seas between Barcelona and Cannes.

DLA Piper partners, meanwhile, are hard at work discussing strategy issues on the 138,000 tonne Navigator of the Seas' rock-climbing wall, basketball court, ice-skating rink, in-line skating track, casino, five-story theatre and mini golf course.

Meanwhile, Queen's Bench judges could also do with a holiday, and much, much further north, lawyers from Denton Wilde Sapte were in the sauna beating those from CMS Cameron McKenna with birch branches after their 27-17 midnight rugby victory.

Event organiser Andy Cotton, a Helsinki-based English partner at Dentons' local best friend Procope & Hornborg, told The Lawyer that though the Finnish "have a good mentality for rugby," he expects the "superior technical skills of the English and French teams" to win through.

Which given that even Finland's national team lost to those titans of rugby football Israel this month, seems like a fair guess.

We're just waiting to see DWS and Camerons take on the Finns at ice hockey.

Alternatively, you could plump for a George III statuary white marble chimneypiece with rectangular breakfront shelf centred by a tablet carved in relief and inlaid with a Greek fret.

Or just grab that two-bedroom terraced house in Hull.

Anyway, whatever they choose, this is the dilemmas facing equity partners at Simmons & Simmons, who have cracked their GBP600,000 PEP target by exactly that sum.

Simmons managing partner Mark Dawkins wouldn't be drawn on the question, preferring instead to talk about practice groups and performance and that sort of thing.

Saucy bedroom toys . It's not often we get to talk about saucy bedroom toys. So we were delighted to receive news of Squire Sanders & Dempsey's earth-moving arbitration victory for the delightfully-named Celine Gueffier over British er, erotic retailer Ann Summers.

Ann Summers built a very successful business back in Blighty by selling a certain type of toy to women in their own homes, and it's turned into a high street chain. It's got so big that there are franchises selling Ann Summers tools and knickers, or panties, in California.

Bryan Cave defended Ann Summers, which could turn out to become a very lucrative client given its controversial past.

In 2006, the retailer outraged Muslims with the launch of a blow-up doll called Mustafa Shag and later upset Apple with its iGasm product, which slotted in to an MP3 player to produce good vibrations for the music lover.

Squire Sanders partner Douglas Rovens was definitely feeling the good vibrations when he greeted the decision as part of a "holy trinity" of California Supreme Court cases, which establish broad arbitration powers.

We knew there was a legal angle somewhere.

Freshfields Bruckhaus Deringer crowned an astonishing couple of years with the Law Firm of the Year prize at The Lawyer Awards last night.

The firm has undergone a revolution which ultimately produced astonishing financial results this year. Chief executive Ted Burke was beaming as he received the gong from cheery host Lord Falconer.

Falconer was in fine fettle, presenting Tyco's EMEA general counsel Trevor Faure with the In-house Lawyer of the Year gong for "scaring the sh*t out of Eversheds".

Bird & Bird managing partner David Kerr put a smile on Falconer's face when he sashayed on to the stage to collect the International Firm of the Year prize with three extremely glamorous young associates. "Kerr and his three birds", joked one of his rivals.

"I thought it was a bit different," he told The Lawyer afterwards. Indeed.

Slaughter and May senior partner Chris Saul and frock-coated JP Morgan associate GC Tim Hailes led the way on the dancefloor as the Bootleg Beatles rocked the Grosvenor until the early hours.

But the night belonged to Freshfields. It may have lost a few partners along the way, but that didn't concern those such as litigation chief Ian Terry and Burke, who happily danced the night away.

Turning out pentrating legal commentary 52 weeks a year can get tiring, so it's a relief when a firm offers us both the story and the comedy.

Step forward Martineau, the Birmingham-based firm that got in touch to tell us it has officially cut off its Johnson.

There was shock and awe on the stateside of the Atlantic this week as news of Linklaters' decision to stand by Barclays at the expense of JPMorgan sank in. See The Lawyer's front page story.

For many Americans the case highlights the gulf between the approach to litigation in the US and UK. One English partner at a top US firm described the lack of any real heavyweight UK firms willing to take on the banks as a "very real problem".

Among the many things the US is not short of is top quality litigation boutiques. More to the point, many of these boutiques aren't concerned about institutional financial services clients getting their knickers in a twist - mainly because they don't have any. Quinn Emanuel Urquhart Oliver & Hedges is a case in point.

The magic circle has always been less keen to take on the banks. As Linklaters has proved, there is a reason for this.

Today, we reveal that Howard Kennedy (no relation) is set to make up to 50 redundancies. Howard Kennedy's woes are not helped by its exposure to the real estate market that makes up almost 50 per cent of the firm's revenues. That was fine last year, when the property market was booming but this year it leaves them painfully exposed.

The firm has a tiny equity partnership (18 out of 75 partners are equity-holders) and plateau partners reaped GBP900,000 last year. The firm's management claims that this year's figures are also looking good but are yet to be audited. A swathe of redundancies while the equity partners rake it in is only going to lead to widespread dissatisfaction.

The market is consolidating fast.

A Heller of a year

Poor Heller Ehrman.

Yesterday (18 June) news broke that another partner was deserting the ship. This time it was litigator John Benassi, who had set his sights on Cooley Godward. Benassi's exit comes just a week after another Heller partner and litigator, Jessica Wolff, also joined Cooley.

The pair's goodbyes takes the total of partner departures at Heller so far this year to at least 20. To be honest, we're starting to lose count.

Throw in those that jumped ship last year and a decent cricket score of partners (that would be around a half century, or 50, for non-cricket lovers) have left in around 18 months.

True, Heller has also hired. But it's impossible not to get the impression that the lustre has vanished from the Heller brand.

As one former partner put it: "There are huge chunks of revenue that have gone along with these partners, many of whom were formal or de facto group leaders in the core practice areas Heller said it was going to focus on, such as real estate, securities and litigation.

"The message from the excom last year was 'let's wait until 2008'. This was their response to a deteriorating franchise and a recognition that there was little internally left to work with."

Insiders, and newly minted outsiders, all say Heller's business strategy is to merge.

Time it got on with it.

So the FSA has decided to clamp down on opportunistic short-selling, following the turmoil surrounding recent rights issues by HBOS and Bradford & Bingley. See story http://www.thelawyer.com/item/133391

Investors will now be forced to publicly disclose their short positions - a terrifying prospect for famously secretive hedge funds.

The move should allow other banks to repair their damaged balance sheets in peace. A good thing, surely?

Not according to City lawyers, who have been given just a week to advise clients before the new rules come into force.

They say the FSA's announcement is unclear and was rushed out without consultation. One partner said: "It feels like it was written on the back of a cigarette packet," pointing to bizarre errors in the text.

The document certainly has a unique style. At one point it announces: "The disclosure must include the of the [sic] name of the person who has the disclosable short position."

The FSA has now released a second statement to clarify the new rules. It might be too early to tell whether it has eased confusion in the City, but at least they appear to have used a spell checker.

Policemen get younger, all the pop music sounds the same and exams get easier every year.

As readers will discover, the number of law students graduating with first or 2:1 degrees has more than doubled during the last 20 years, according to new research.

Professor John Usher, head of law at the University of Exeter, which saw an increase of 196.1 per cent, denies that standards have dipped, maintaining that its just that "we're just attracting better students and our teaching has significantly improved."

As presumably is the case at Birmingham, Birmingham City, Bristol, Brunel, Central Lancashire, Dundee, Durham, Edinburgh, Essex, Exeter, Glamorgan, Huddersfield, King's College London, Southampton Solent, Middlesex, Newcastle, Nottingham, Coventry, Leicester, Liverpool, LSE, London Met Manchester, Manchester Met, Oxford, Queen Mary London, Reading, Sheffield, SOAS, South Bank, Strathclyde, UCL, UEA and Warwick universities.

On Friday (13 June), we reported that Simpson Thacher had ramped up its executive compensation capabilities, snaring Tristan Brown from Akin Gump in Palo Alto. The back story is that one Simpson partner had retired and another moved on in Silicon Valley, making Brown's hire essential.

Just the day before (Thursday 12 June), we covered the move of former McCarter & English managing partner, Steve Eckhaus to Katten Muchin.

In an entirely unrelated chain of events, over the weekend the bell began to toll for AIG CEO, Martin Sullivan. By Monday (16 June), the story was out in the open: another day, another credit crunch job loss.

For both Simpson and Katten (which is thought to be advising Sullivan), the timing could not really have been any better.

Executive compensation might not sound the like the raciest area of practice, but in the current market it might just prove to be one of the busiest.

As PR moves go, threatening to sue an eleven-year old over his love for a much-treasured work of children's literature is probably about the worst possible.

Still, business is business, so Baker & McKenzie has duly sent an 128-page legal complaint to parents Mr and Mrs Saville-Smith of Edinburgh (see story).

The dispute concerns Narnia.mobi, an internet domain name - that's the second half of an email address, technophobes - which the couple registered in their son's name as a birthday gift -much to the irritation of the estate of Chronicles of Narnia author CS Lewis.

Unsurprisingly, Baker Mac is keeping its head down and refusing to comment, and The Lawyer understands that as yet Mr and Mrs Saville-Smith are eschewing offers of pro bono help from, pleasingly an English firm, an Irish firm and a Scots one..

Thacher banishes Proffitts of doom

There was refreshing candour in the comments made by Thacher Proffitt & Wood managing partner Paul Tvetenstrand today (see story).

Thacher Proffitt, reluctantly, became one of the legal market emblems of the downturn last year, when in December it became one of the first major firms to make significant layoffs among its ranks of associates. Certainly it was one of the first to do it publicly.

A debate is still raging in the US market over how many firms have laid off associates using stealth rather than frankness. All the signs point to Thacher Proffitt being firmly in the latter camp.

In total since the credit crisis began the firm has laid off around 55 associates - some 25 per cent of its total number this time last year.

Tvetenstrand's willingness to confront that reality head on internally, and his unwillingness to blame anything other than economic conditions for the job cuts, is refreshing.

With his comments to The Lawyer, he appeared to draw a line under that period of Thacher Proffitt's history. The high number of partner departures suggests that not everything is tickety-boo, but at least with Tvetenstrand you get the feeling that if there is more pain to come, he and the firm won't try to hide it.

Long-term, that transparency can only benefit them both.

In case you didn't recognise its distinctive call, that was the sound of a pterodactyl flying to the top.

A reverse pterodactyl, specifically, also known as the lesser-spotted CV-cheating, dinosaur-impersonating, self-proclaimed rough diamond Apprentice winner Lee.

(That's what we're talking about).

Lee scored a shock victory over bookies-favourite Claire in the final of the BBC hit after his Alpha team pulled together in its task of launching a 'men's fragrance' - despite Lee's nerves almost getting the better of him at the presentation stage.

At the risk of sounding like a stuck record, today's Lawyer News Daily is dedicated to the diversity row between Eversheds and the recruiters.

Or at least that's who it used to be between. Some 58 reader posts on TheLawyer.com later and it's all become a lot more, well, diverse.

Sub-debates have emerged concerning diversity monitoring, public schooling, Jews in the law, disability hiring, discrimination against white people, representation of men, the merits of positive discrimination and just who should take the heat when law firms don't recruit minority lawyers. Oh and on, er, diversity at NASA.

"Why don't BMEs just get over it?" wrote one poster at 12.03pm today. "The problem is that candidates need to be realistic - you can't get a degree from an old poly and expect to get a training contract with a top international firm."

Another argues that "Jewish people don't need special help to enter the law as they are already very well represented" (12.43pm), while a post at 11.40am says that "there are some great HR Managers out there who really do see the skills a disabled person can bring, but it's the partners who make the ultimate decisions".

Anyone sticking up for the rule of law is to be praised in our books, and when its lawyers themselves, all the better. Though not all our readers agree.

"It is concerning to read about lawyers hanging, beating and setting on fire an effigy of Musharraff, however dislikable a character he is - shouldn't lawyers be upholding the rule of law rather than encouraging mob violence?" wrote one TheLawyer.com site user early this afternoon.

'Joe Bloggs', meanwhile, focused on the PR aspects of the protest, putting Pakistani lawyers 'in stark contrast to our unfair reputation here as cynical bloodsuckers'. Have your say here.

Forty-eight hours after the candidates in the marathon US presidential election were finally whittled down to two, a controversial figure from the UK's political past issued a warning to the future American leader and a few lawyers.

The name Peter Mandelson was once enough to drive a shudder down the backs of many a British politician. Yesterday, in the elegant surroundings of the Metropolitan Club in Manhattan, Tony Blair's shadowy spin doctor called up some other rather notable names from the past to help him warn the assembled dignitaries about the dangers of protectionism. Mandy's theme was simple: We're all in it together. And whoever takes over from Bush in January better not have protectionism in mind or, presumably, he'll have Mandy to answer to.

I spotted lawyers from Linklaters and Alston & Bird in the audience. They seemed to be clapping along with the rest of us as Mandy called for confidence in addressing, "the biggest re-structuring of economic life since the industrial revolution".

Just a thought, but could it have been the thought of the fees generated by a wholesale restructuring of economic life that was making the representatives of Wall Street applaud?

But that's just our spin. Something Peter Mandelson would no doubt appreciate.

That was the fate of Eversheds, which has ignited a row with recruiters after slamming them for "getting away with murder" by not monitoring race, gender or sexuality among their proteges. See cover story

Did lawyers spike our drinks last night? Or did we imagine it?

Did we really see a faceless upside down greyhound? A bowler-topped doorman?

Was that a hallucination in those dark, dark loos, or was the paper really hanging on chains? And what about the French maids and mind-readers?

Ah, no. This was the latest attempt to claim Trendy Law Firm Of The Year*, with Nabarro snubbing City wine bars in favour of the sensory cornucopia that is West End haunt Sketch.

So confusing was the whole psychadelic experience that one legal journalist is understood to have got lost and ended up in the restaurant kitchen.

Ominously enough, some Nabarro lawyers were also overheard discussing how to spice up the firm's desert of an atrium.

We can only hope managing partner Nicky Paradise doesn't pick up any interior design ideas.

Going nuts for Brazil

Three months ago, Chadbourne & Parke snared an estimated $30m business in Mexico in the form of Thacher Profitt & Wood's Mexican operations.

No disrespect to Mexico, but now that looks as if that was merely a precursor to a bigger play: Brazil.

The news that Chadbourne is to open an office in Sao Paulo later this year is confirmation both of the US firm's ambitions and of the potential in Latin America (See story).

Latin American practice group partners Allen Miller and Talbert Navia will spearhead Chadbourne's latest adventure, drawing heavily on the lawyers and relationships it gained in March.

The likelihood is that when they get down to Sao Paulo, they won't be short of company from foreign lawyers.

Brazil might still be lagging behind China and India in terms of its BRIC attractiveness, but in legal market terms at least, it's pulling out all the stops to catch up.

Last night Eversheds held yet another party to celebrate its new office (you know, the one with the sheep on the roof and the bras in the flooring). We thought it was lovely.

And there's plenty of space to expand into. Almost enough space to merge with another London firm - the size of, oooh, McGrigors, say.

After entirely unconvincing denials of merger discussions from both McGrigors and Eversheds, we can only say: pull the other one.

For as thelawyer.com revealed yesterday, Eversheds just took on former McGrigors chief Colin Gray, plus banking partner Colin McKay.

A move oddly reminiscent of when Ashurst managing partner Justin Spendlove left for Fried Frank, just a few months after talks between the two firms collapsed.

It looks as if the real story behind Gray's move is that McGrigors has stalled in the City. Two years ago, Gray announced internally that he wanted McGrigors to get to GBP100m in turnover in order to be taken seriously in London.

That hasn't happened; the firm had revenues last year of GBP60m, according to The Lawyer UK200. You couldn't blame Gray if he felt frustrated with the lack of progress. No wonder he jumped to now-bullish Eversheds.

If you can't merge with 'em, join 'em, eh?

Freshfields has had a great year, as its remarkable average profit per equity partner (PEP) hike of almost 40 per cent shows. See story.

As evidenced by user comments on TheLawyer.com, some readers are a little bit cynical about Freshfields' stellar year, observing that "getting rid of 100 equity partners" has boosted PEP while "if you take the [euro] exchange rate from last year, then the percentage increase on turnover is only around 9-10%".

However, Freshfields has plenty of fans, with one anonymous reader posting "very impressive results, especially when you consider that Freshfields don't massage their numbers by making a huge chunk of their partnership non-equity like some of the other usual suspects".

With its 39 per cent increase to GBP1.44m, Freshfields' average profitability has leapfrogged Kirkland, Cleary, Paul Weiss, Milbank, Willkie and even Cadwalader. It has even squeezed ahead of Simpson Thacher & Bartlett.

Clearly, Freshfields has a lot going for it right now. As chief executive Ted Burke points out, the firm's wide international coverage (and Asia in particular) has been a boon over the past year or more.

Inevitably what the firm's new profits peak does put squarely back onto the agenda is its US merger ambitions.

It was just over two years ago that Freshfields' senior partner Guy Morton put a tie-up with a US firm at the top of his personal to-do list, saying in his first interview since taking the post, "I think the partners are ready mentally for a merger".

Comparative financial performance has long been the traditional barrier to a top-tier, US-UK tie up. Not now.

Now the most pertinent question might be, would a potentially dilutive merger with a Wall St titan be in the best interests of Freshfields?

Another day, another magic circle financial results announcement.

Last week Clifford Chance was first off the block, announcing a modest 11 per cent rise in turnover coupled with a 13 per cent increase in average profit per equity partner (PEP). See story.

Today, Freshfields has unveiled an incredible 39 per cent PEP hike and a perfectly respectable turnover increase of 19.5 per cent.

Clearly the firm's restructuring last year which saw it cull 100 partners from the equity (see story), has had the desired effect on PEP.

This year's average take home of GBP1.44m is enough to make rivals green with envy (and force a few US firms to take note). But more interesting is the firm's turnover growth and what it means for the rest of the magic circle.

Freshfields' 19.5 per cent seems to have come easily, and given the firm's deal presence even during the past six months alone, is hardly surprising.

But if Linklaters, which has yet to announce its results, can match that rate of growth, it will knock Clifford Chance off the number-one-firm-in-the-world-in-terms-of-turnover pedestal it has occupied for, well, ever. And with Linklaters' transactional record during the past six months, that's all but a done deal.
