Fairtrade labelling scheme.

A leg-up to the world's poorest farmers or a wilful
distortion of market economics, depending on your point of
view, the Fairtrade scheme adds a social-investment premium
to the price of labelled products to benefit the dirt poor
producers of low-priced 'cash crop' commodities.

But then of course you knew that.

Norton Rose certainly does. Not only are the firm's chocolate
and hot drinks all Fairtrade-stamped, even the cups and cotton
napkins have the Fairtrade mark of approval. Hell, so does
the canteen rice.

Not to be outdone, Freshfields Bruckhaus Deringer, still
riding the PR wave of being the world's first ever law firms
to publish an externally-approved CSR report, has a 'showcase
table' in the restaurant decked with chocolate and snacks,
and has upped the Fairtrade-count on the canteen menu. In your
face again, Linklaters!

Hell, even the most un-PC of managing partners we spoke to
says his firm uses a brand of Fairtrade tea. Even if he
personally does think "it's horrible".

Last time out they were pitched in to battle against each
other for the vacant managing partner role, but the former
foes have been united. And following their election victory,
which was confirmed late last night, the new managing partner
and senior partner of Allen & Overy were all smiles during
their first joint interview with the press.

Managing partner elect Wim Dejonghe said: "My predecessor
was a pretty decent guy - he knew what he was doing."

We're not sure if he proffered a cheeky wink to his
predecessor David Morley, the firm's new senior partner,
but the pair were certainly feeling affectionate towards
one another.

Which is a good thing. Belgian Wim will be moving from his
home in Antwerp to London soon, to be closer to David. And
they'll be working together every day for the next five years,
in sickness and in health, till vote do them part.

The firm was on tenterhooks yesterday and forced the
independent election auditors to work late to get the
results in - by 6pm. It's understood that no late night
taxis were required.

David, for his part, was equally affectionate towards Wim.
The new senior partner says he expects "confidence and
adventure" from his future with Wim, who he insists is
"still a very young guy", despite having celebrated his
birthday yesterday.

Sounds like a match made in heaven. Bless.

The news rollercoaster that is Cadwalader Wickersham & Taft
went freeform yesterday, when it announced it had appointed
global finance head Chris White as firmwide chairman
(see story).

For Cadwalader, it means saying goodbye to the long-running
solo leadership of iconic managing partner, Bob Link.

Don't get too excited; Link will still be there as managing
partner. He'll just have his old golfing buddy Chris White
alongside him to help out a bit.

The firm's spin runs like this: because it is diversifying
away from its structured finance and capital markets core it
needs a bigger management structure to reflect the broader
base. In a nutshell, White's job will be strategic and Link's
operational.

The reaction here is this: Cadwalader's core market has died
and the firm needs to act. See this as a first step.

What to Do when a Dog Bites You!

Are you afraid of dogs and being bitten by them? Well, you are not alone.
Dog bites are very common cause of injuries in not only children but also adults. Dog bites can cause serious consequences from psychological trauma or permanent deformity. And the worst consequence of a dog bite is death.
It is eerie in a way to say that dog bites are a nightmare coming from what is supposed to be a man s best friend.
There is actually a dog bite epidemic in the United States. Dogs bite almost 5 million or 2% of the country s population, annually. Most of the victims are children, often bitten in the face.
From this number, 800,000 are in need of medical attention. Meanwhile, 1,000 each day need to undergo treatment in emergency rooms. Sadly, 15 to 20 die from dog bite injuries and complications, annually.
This number just goes to show that no one is securely protected from sudden dog attacks. However, there are ways to prevent being bitten by a dog. First, remember that there is no such thing as a dog that does not bite.
Pet dogs are still dogs that would most possibly bite. It is better to keep distance and exercise great care when dealing with dogs, your pet or otherwise. Do not be among those who became victims of pet dog attacks.
Experts and medical practitioners have provided many lists of precautionary measures on how to deal with dogs and avoid being bitten.
However, if you still managed to be bitten by a dog, then here is some information regarding your legal rights to recover damages.
1. First is to identify the dog. You must find out if the dog has rabies. Nevertheless, you should get medical attention, immediately and be shot with anti-rabies vaccines.
2. Immediately after the dog bite attack, report the incident to the authorities. They can help in investigating the circumstances of the dog bite. Their report would help in establishing the incident.
3. Avoid getting into an argument with the owner of the dog. Remember that many owners dote on their pets and would not believe anything negative about them. Understand that it may be hard for them to accept that their dog can bite even without severe provocation.

Dept of Justice cover up of fraud, perjury & RICO connected to Mitt Romney

Contrary to their oath of office, 28 USC 586(a)(3)(F) and in direct violation of 18 USC 3057(a) the United States Trustee actually & speciously sought immunity for the felony violations and the US Trustee has aggressively sought to assist defrauding our Court approved contract work by seeking to strike and expunge our proofs of fraud and perjury by powerful law firms connected to Mitt Romney. The Asst US Trustee Frank Perch did motion to disgorge Traub $1.6 million, but mentioned nothing about the false affidavits of Morris Nichols (MNAT) The Director of the Dept of Justice EOUST emailed us that he would take care of the issues. The the US Attorney for the new Region 3 Trustee, Mark Kenney offered the right to circumvent the law and a "get out of jail free card" to the perpetrators. MNAT represented both Bain and eToys when it the court approved the selling of the eToys assets to Bain. This is Collusion to defraud the estate for tens of millions of dollars.MNAT now represents Bain in the KB bankruptcy case (Del Bankr 04-10120). We have now found the missing link, just this past week, that offers explanation of the "nolle prosequi" of the Dept of Justice, that being the reason why the US Attorney s office has refused to prosecute MNAT. For the US Attorney for Delaware is Colm F Connolly. Connolly was (and may be still) a partner at MNAT when eToys sold the assets to MNAT s other client Bain. Lawrence Friedman, Frank Perch and Debra Yang (Pres Bush Corp Fraud Task Force) have all subsequently resigned from their key positions at the Dept of Justice, without providing an sufficient remedy of the matter. The US Attorney in Delaware who has refused to prosecute MNAT or Bain is Colm F Connolly, who is now being considered for a Fed Judge position. As such Connolly s resume is now public knowledge. . While it seems to be a good career move not to investigate or prosecute your partners, associates and clients. Especially when such is connected to your future boss, a Presidential hopefull. Which states, the Courts are forbidden from contravening clear, unambiguous statutory mandates of 327(a). A finding of non disclosure of conflict of interest mandates disqualification. When it crosses the line of "or else" threats of liberty and physical well being, with Dept of Justice complicity and breach of fiduciary duty, then we have no choice. If they had done the right thing, settled and made some amends previously, when we told them no to their gratuitous offer, this all could have been avoided. After three years of buoyancy, Halliwells is coming down to
earth.

It has launched a redundancy consultation process across its
London-based corporate team, as a result of the group lagging
behind budget. It is understood that seven or eight solicitors
and support staff are likely to follow the departures of head
of corporate Julian Lewis and partner Martin Walsh. See story.

In trying to establish its presence in the capital, the firm
faces the same quandary as some of its national counterparts
- how to balance an identity and client base forged in the
regions with the expense and rampant competition for London's
rainmakers.

The official story? That Halliwells retains its commitment to
the City. Indeed, managing partner Ian Austin is saying that
growth will continue and that London has "good earnings and
high potential".

Austin is clearly a glass half-full kinda guy. He'll be
crossing his fingers that earnings really are tip-top if the
firm is to make up for the fall-off of major insurance clients
such as Norwich Union and the loss of lawyers to regional rivals.

Shiny new HQs, such as the ones the firm took over at
Spinningfields in central Manchester last year, may look good
for branding, but there are an awful lot of attendant costs.

Setting up a new business in the U.S.: Choosing between L-1 or E visa

Setting up a new business can be quite exciting. But there are also many challenges. In-depth market research and planning can minimize the risks. Foreign nationals setting up a business in the US face another challenge which visa do they use to be able to enter the US to operate the business once it has been established? Generally L-1 visas are used to set-up a new entity in the U.S. when it is a subsidiary, parent, branch, or affiliate of an overseas company. However, foreign nationals from countries with certain treaty with the U.S. have the choice of using E-1, E-2 or L-1 visa for establishing a new entity in the U.S. Let us first understand the situations under which each of these visa options can be used.
E-1 visa: The E-1 treaty trader visa allows nationals of an E-1 treaty nation to enter the U.S. and carry out substantial trade. Trade means the international exchange of goods, services and technology. The item of trade, and title of that item, must pass from one party to the other in exchange for consideration. The international trade between your home country and the U.S. must be substantial in the sense that there is a sizable and continuing volume of trade. More than 50 per cent of the international trade involved must be between the U.S. and your home country.
E-2 visa: The E-2 treaty investor visa allows foreign entrepreneurs from E-2 treaty nations to enter into the U.S. for the purpose of directing and developing the operations of an enterprise they have invested in, or are in the process of investing, a substantial amount of capital. Investment activities include purchase of a new business. The investment must be significantly proportional to the total investment, that is, usually more than half the total value of the enterprise or, if a new business, an amount normally considered necessary to establish the business.
L-1 visa: The L-1 intra company transfer visa allows foreign nationals to enter the U.S. to open a new office in the U.S. of a foreign corporation, provided that premises for the U.S. office have been secured and money has been invested in or set aside for operation of the business. To qualify for an L-1 visa, the applicant must be an executive, a manager or an employee with specialized knowledge of the company s business and its products and services, and the employee must have worked for the company overseas for one year in the three years before applying for the L-1 visa. Further, a qualifying relationship (such as parent-subsidiary, branch or affiliate) must exist between the foreign and the U.S. business entities.
Factors governing the choice of appropriate visa
Following are the basic issues that determine the choice of the most suitable visa category to set-up a new office in the United States:
1. Country of nationality
E-1 or E-2 visas can be used only if a treaty of commerce and navigation or a bilateral investment treaty exists between the U.S. and the country of nationality of the foreign company or investor. If the foreign national does not belong to a treaty country, the choice is generally limited to L-1 visa.
2. Nature of business
E-1 visa can be used by foreign entities not having a substantial investment in the U.S. but having a substantial trade with the U.S. The substantiality of trade is determined by the volume of trade, number of transactions and the recurrence of these transactions. E-2 visa can be used to set-up an entity in the U.S. if the investment involved is substantial. L-1 visa does not have the requirement of substantial investment in the U.S. It can be used for any venture by international companies to set-up a branch, subsidiary or affiliate company in the U.S.
3. Employment with foreign entity
To qualify for an L-1 visa the applicant must be an executive, manager or a specialized knowledge employee who has been an employee of the foreign company for at least one continuous year within the last three years. There is no such requirement for E-1 or E-2 visas. A treaty national with no foreign employer intending to make an investment or set up a business entity in the U.S. does not have much of a choice other than the E visa, if the rest of the conditions are satisfied.
4. Qualifying relationship
The L-1 visa can be used to transfer an employee of a foreign entity to set-up, manage or work for a related organization in the U.S. The qualifying relationship may be in the form of a parent, subsidiary, branch or an affiliate company. For using E-1 or E-2 visa, the company or the individual engaging in trade or investment in the U.S. must have the same nationality as the treaty country.
5. Processing Authority
E visa applications are generally filed with the embassy or consulate in the home country of the applicant. Once the consulate registers the trading or investing enterprise for E visa purposes, the treaty national may apply for a visa to enter the U.S. On the other hand, L-1 visa is a two-step process. A petition is first filed with the appropriate Service Center of the U.S. Citizenship and Immigration Services (USCIS). Once the petition is approved the applicant can apply for a visa at the consulate abroad. An applicant who changes to E status in the U.S. by filing a petition with the USCIS may still have to repeat the entire application process at the consulate the first time he departs the U.S. An applicant changing status to L-1 in the U.S. needs to only obtain an L-1 visa stamp in his passport to reenter after he departs the U.S.
6. Processing Time
Even though E visa petitions are processed directly at the embassy or consulate, the adjudication is complex and time consuming, and may take several weeks depending upon the consulate. Generally it takes two to three months for most of the consulates to adjudicate an E visa application, with practically no provision of expediting the process. An L-1 visa petition generally takes several weeks to process at the USCIS Service Centers; however, the processing time can be reduced to less then two weeks by utilizing the premium processing service.
7. Period of Initial Employment
E-1 or E-2 visa may be granted initially for a period of two years whereas an L-1 for a new company is granted initially for a period of one year. After the expiry of the first year on L-1 status, the applicant has to show that the new U.S. company has been doing business during the past year, and continues to require the services of the applicant as a manager, executive or an employee with specialized knowledge. Companies that anticipate a slower start to get established in the U.S. may use E visa option that gives them a two year initial period to set-up their operations.
8. Limit on Employment
An E-1 or E-2 visa can be extended indefinitely for up to two years at a time provided that the stay of the applicant remains temporary. An applicant in L-1 status in the U.S., however, cannot extend his/her L-1 stay beyond a period of 5 years (for specialized knowledge employees) or 7 years (for managers or executives). Once the employee has spent one full year outside the U.S. they can start their time in L-1 status again.
9. Intention of obtaining a Green Card
The L-1 may be the best route in cases where the intention of the applicant is to ultimately apply for a green card during his/her stay in the U.S. An L-1 visa holder may pursue permanent residency and still maintain L-1 status and apply for extension of stay. This may not be possible for E-1/E-2 nonimmigrant. E-1 and E-2 visas, though they can be extended for an indefinite period of time, still require the applicant to maintain nonimmigrant intent. Starting the permanent residency process may affect the applicant s ability to maintain or extend E-1 or E-2 status; however the USCIS and the consular officers generally will accept the statement of the applicant with respect to his or her nonimmigrant intent.
10. Evidentiary requirements
An E-1 or E-2 visa application entails complex evidentiary requirements as the applicant needs to prove the substantiality of trade between the U.S. and the treaty nation, or the substantiality of investment in the U.S. Further, since E visa applications are generally adjudicated at the consulate, no formal appeal or recourse to administrative or judicial review in the U.S. is available for adverse decisions of the consulate. L-1 visa applications for a start-up enterprise require evidence related to the business and revenues of the foreign entity; the qualifying relationship between the foreign and the U.S. entity; and a detailed business plan explaining the potential of the new entity and its capability to meet business expenses, including the staffing requirements. However, a decision made by a USCIS Service Center can be reconsidered at various stages by the administrative and judicial machinery within the United States.
Conclusion
Finding your feet in a foreign land can be quite challenging, often difficult. As noted above, nationals or enterprises from treaty countries have an advantage of choosing between E and L visa categories for setting up a new entity in the United States. And when different options are available, it is important to make a strategic, well-reasoned selection. The Single Most Important Thing to Know about Verbal Agreements

How many times have we run afoul of film producer Samuel Goldwyn s famous maxim: "A verbal contract isn t worth the paper it s written on"? (I ve certainly done it). And yet, isn t life nicer, simpler when you don t have to worry about creating a paper trail? Why not just trust the people you re doing business with? Isn t my word my bond?
"Jared" had had the same attitude. Jared is an easy-going computer geek, more interested in creative problem-solving for his tech support clients than printing out every possible piece of paper to cross "t"s and dot "i"s. That said, Jared had a written lease for his office space, under which he was responsible for paying his share of real estate taxes. Last year, the taxes skyrocketed. So when he received the bill, he called the landlord (a college classmate) to work out a payment plan, instead of paying the taxes in a lump sum. Because they were friends, Jared didn t confirm his agreement in writing, thinking the landlord agreed to the arrangement. Yet months later, the landlord imposed late fees for the delayed payments, and Jared faced fines totaling several thousand dollars. Ouch!
Agreements do not always have to be in writing to be binding and enforceable. But the most important thing to remember about verbal agreements is this:
For verbal agreements to work, they require the complete, accurate, and fair memory of both sides.
Which, in reality, rarely happens. Memories are selective. And fallible. And faulty. Have you ever had a client who ignored your advice, made a mistake, and then blamed you for not telling her about the potential pitfalls? Welcome to selective memory. A vendor who provided you with thirty (30) items instead of the thirty-eight (38) you needed? Hello, fallibility. People remember what they want to remember, which usually is not in your favor. Ever had trouble remembering the name of someone you met repeatedly at networking events? You can thank your faulty brain cells.
There are a number of significant deal points that Jared and his clients might recall differently, because of selective, fallible, or faulty memory, such as:
1. The number of hours of computer tech services that Jared would provide 2. How much time Jared would have to respond to a technology "emergency" 3. How much Jared would be paid and within what time frame 4. Whether an agreement would automatically renew unless cancelled within a particular time frame 5. Whether there would be penalties for non-payment 6. Whether, as with the landlord, they decided to make any changes to their previously agreed-upon relationship 7. If there were any special arrangements that were not standard in the industry, such as the whether and how much interest Jared wanted to charge on outstanding balances 8. How you would handle disputes, if any arose
Any one of these areas can create a contentious "he said, she said" situation if your respective memories don t agree. And these are the "honest mistakes." Verbal agreements give you little defense against those who would actively seek to "burn" you, if that s the scheming way they choose to conduct their business.
Finally, don t ignore the costs to your personal relationships if you are doing business with family or friends, as Jared did. People tend to take for granted that their friends and relatives are "on their wavelength" when it comes to doing business. Especially with closer relationships, do not assume anything. Be extra careful to treat the deal like you were working with a stranger. What you risk is not only the deterioration of the business relationship, but the personal one as well. That s a high price to pay, when it could have been solved easily and wisely by putting pen to paper.

Forget the Speaker of the House of Commons. It seems an even
bigger expenses row has emerged at Clifford Chance.

Elusive Clifford Chance London managing partner Jeremy
Sandelson has turned into a big stern scary man while
simultaneously skewering all positive predictions for the
firm's end-of-year financial results.

It seems that paying for everyone's taxis home late at night
has been hitting his and fellow partners' wallets quite hard
in these "quieter times", he wrote yesterday afternoon in an
email to all London staff. See story.

Apparently, taxi use has in recent times "risen to unacceptable
levels".

After initially blaming those dastardly folk at the Revenue,
Sandelson then went in for the killer blow. "Reports have
come to my attention," he declared, "of people going out
socialising and then returning to the office to get a taxi
or simply hanging around the office until they can get a
'free' taxi home."

"It appears," wrote Sandelson, "that a small minority may
be taking advantage of the system."

That's right, Jeremy. We're sure everyone would much prefer
to hang around the office for hours instead of going home,
just for a fabulous opportunity to sit in a cab.

And if Clifford Chance didn't want to spend money on taxis,
why on earth did it move to Canary Wharf?

What Is The Corporate Agent for Service of Process?

When businesses decide to incorporate, there are a lot of issues to confront. One of them is designating the agent for service of process. The problem is most people don t know what this is!
A corporation is a formal business entity. Under long established law, it is considered an person independent of its shareholders. In human terms, this means it acts alone much as a person would in business. It must file taxes. It can be sued. If it is sued, its shareholders cannot be named as defendants. This corporate shield from personal liability is the big benefit of incorporating.
To gain the protection of a corporation, the business must be run in a particular way. This is known loosely as corporate compliance. If the entity is in compliance, the corporate shield protects the shareholders. If it is not, the shield can fall and the personal assets of the people involved can be exposed to liability. There are a lot of factors that go into corporate compliance. A simple, but misunderstood, one is the designation of a resident agent for service of process.
There is a legal fiction that is in place when it comes to corporations. Although they are considered to be a independent person for legal purposes, they obviously are not flesh and blood. This causes a conflict with other areas of law. For instance, a person can only pursue a lawsuit if they serve the lawsuit on the defendant. This is typically accomplished by walking up and handing them the lawsuit papers. This is a bit difficult to accomplish with a corporation since there is no physical body.
To resolve these conflicts, the position of the agent for service of process was created. Essentially, a living person is chosen to act on behalf of the corporation. If someone wants to file a lawsuit, they deliver it to the agent for service of process. The agent is not a defendant in the lawsuit, just the person who officially receives it.
So, who can act as the agent? Well, it depends on the state you are incorporating in. Generally, it can be just about anybody so long as they live in the state and are willing to have their name and address listed in public records. Often, the attorney forming the entity will act as the agent, but not always.
If you are considering incorporating, you need to take the time to figure out who will be designated as the agent for service of process. If you fail to do so, your incorporation documents will be rejected by the Secretary of State for your jurisdiction.

Dewey & Leboeuf chairman, Steve Davis called 2007 an
"extraordinary" year for the firm. While it's arguably
fair to describe the merger of Dewey and Leboeuf as
extraordinary, it's pushing it a bit to say the same
about its first-ever set of financial results. See story.

Global revenue was up by just over 9 per cent to $1bn (GBP500m).
Average profit per equity partner rose by roughly 10 per cent,
to $1.57m (GBP785,000). It's not too bad, but set against other
firms' figures, at the low end of average.

Then again, Dewey & LeBouef's year was anything but average.
First, there was that merger. Then Davis took control and
started to make his presence felt. He binned the London
management team and took responsibility for both sides of
the Atlantic. Then he instituted an exceedingly complex
structure where just about everybody had a management role
of some sort.

The firm's first big external move was a two-partner raid on
Akin Gump to launch in Dubai. Davis says there will be more
changes to come in 2008 as he seeks to fully integrate the
two legacy firms.

But given the current economic conditions, Davis has promised
to slow down with the lateral hires. Given the firm's massive
expansion during the last two years, that is probably a wise
move. But Davis is more than capable of springing a few more
surprises during this crucial integration.

Paul Olney and Graham White are to take on the practice
partner and executive partner roles respectively. The pair
will work alongside senior partner elect Chris Saul - the man
who has pledged to put the fun back into the law - but,
unsurprisingly, neither plans to revolutionise their new role.
And neither, so far, has talked about fun, oddly.

While Saul wants to highlight the 'lighter side' of the law,
ultimately he plans to continue the job currently being done
by incumbent Tim Clark. Same goes for Olney and White.

"The role will not be very different from the role that David
Frank has had as practice partner," said Olney. "There is
nothing I'll need to do immediately I take over - I will
continue the job Melvyn Hughes has been doing," added White.

Perhaps Saul's yet-to-be-announced successor as head of
corporate will manage to shake things up just a little. But
don't bet on it.

The report also concluded that the reputation of lawyers who are experts in personal injury claims and litigations and all other lawyers have not been tarnished because of the television advertising.

year, when the nine-strong selection panel launched its
search for the next round of silks (see story). It's a bit
like the X-Factor really.

Scratch that - a lot like the X-Factor. You have thousands
of desperate hopefuls, all ready to jump through some pretty
high hoops to fulfil their ambitious dreams. On the other
side you have the experienced panel, suspiciously eyeing up
the contestants between coffee breaks and arguments over who
should win.

Panel chair and former NHS chief executive Sir Duncan Nichol
is the Simon Cowell figure, who can make and break careers
with a nod or shake of his head.

But there are a few important differences. Unlike the X-Factor,
you have to pay GBP6,000 plus VAT if you win. And the screaming
fans are replaced by a pat on the back from the senior clerk.

Despite the dodgy prize at the end, the QC selection process
could still make for a great TV show: Silk Idol.

Is Shearman & Sterling's 9.36 per cent revenue hike a return
to form? Well, it's not bad, considering the last six months
of 2007 were a struggle for most global firms.

This time last year, things were looking pretty gloomy for
Shearman. The 1 per cent revenue increase at the end of 2006,
during the height of the boom period, didn't bode well.

But with its $921m (GBP460m) global revenue for 2007 it appears
Shearman is fighting back. Critically, profit per equity
partner (PEP) was up more than 11 per cent. Could Shearman
be on the mend? See story.

London managing partner, Kenneth MacRitchie certainly thinks
so, but he probably would, wouldn't he? MacRitchie
described 2007 as "a rewarding year".

While London's 15 per cent revenue growth took its City
turnover to $132.6m (GBP66.2m) and the global figures look
healthier than last year, one year of good results doesn't
get the firm out of the woods just yet.

In New York Shearman is still seen as being plagued by its
former demons, primarily a disconnected global network.

As one former partner said: "I don't think Shearman is back
on track. Yes, the results are better than last year but the
offices are still not good at promoting a referral network
between offices. This is essential for a global firm."

Still a work in progress, then.

The firm has hired its 16th lawyer in Europe this year,
bagging Grupo Ferrovial's corporate head of legal Maria
Segimón de Manzanos for its Madrid office. See story.

DLA has hired 16 lawyers in the 51 days since Big Ben chimed
for the first time in 2008. That works out roughly at one
lawyer every three days. If the firm keeps up this pace,
it will hire another 116 European lawyers before the end of
this year.

It sounds like a lot but it should be no sweat off DLA's back.
It is a leap year, after all.

If anything, 116 lawyers is a sign the firm is slowing down.
Between 2006 and 2007 the firm managed to hire a whopping 419
lawyers in EMEA. With the credit crunch kicking in, the
partners might not be busy, but the HR function certainly will
be.

Credit Repair Information

You may have heard that bad credit report repair is impossible or illegal. Bad credit report repair is possible and if you contact a law firm which specializes in credit report repair, then it can all be done legally. If you contact a company that is not a law firm, then they may be doing something ineffective or illegal. The only way to be confident that the credit repair information you are getting is legal, accurate and effective is to contact an attorney. Not all attorneys specialize in bad credit report repair. Those who do generally charge a fee for initial consultation and a monthly fee, one company offers to refund overpayment if they are not able to remove a substantial amount of negative credit report information. Some companies charge for credit repair information, giving you what amounts to helpful hints; where to get your credit report; how to write a letter and other so called credit repair information that you can find on your own for free. These and companies that advertise that they can accomplish bad credit report repair in less than thirty days should be avoided.
Whether it is referred to as problematic , less than perfect or just bad credit , anyone with a credit score below 680 can benefit from bad credit report repair. Why? Because lenders charge higher interest rates to people with what they call sub-prime credit scores. How much can that amount to? A $20,000 car that is financed for a period of five years at an interest rate of 14% for someone who has sub-prime credit costs them an extra $4722 in interest. At 20% for someone with bad credit, that same car costs an extra $8593. If bad credit report repair is effective and costs around $1000 (could be less, could be more), then a person with less than perfect credit would still save almost $4000 and the person with bad credit would save about $7500. Bad credit report repair is a worthwhile investment.
None of this can be accomplished if you are currently behind on payments to your lenders, whether credit cards or loans. You may need debt management or credit counseling, but you will not need credit repair information until you can put these issues behind you. Credit counseling, while helpful when you are in over your head, is not the same as bad credit report repair. Even if you have had a bankruptcy, bad credit report repair may be helpful.
It is sometimes possible to achieve some results on your own, but it may be time consuming, frustrating and ineffective. You will also be unaware of everything that you can accomplish unless you contact a lawyer that specializes in bad credit report repair. The credit repair information available from credit bureaus and government agencies only mention some possibilities; how to report discrepancies or inaccuracies. Sometimes, items are not removed in a timely manner, even though the credit bureau says this is not true. If you cannot afford to hire a legal firm, you can begin bad credit report repair by writing a letter which disputes information listed on your credit report to the appropriate credit bureau. They have thirty days to respond. Suggestions for writing these letters and addresses for the three major credit bureaus are listed in an earlier post. You should try to keep all emotion out of these letters and put your request in very simple terms. You may have to write a follow-up letter, if the credit bureau does not respond in a timely manner. This letter should also be unemotional and simply state that you have waited a reasonable amount of time (30-45 days) and you would like the inaccurate information removed immediately and a new copy of your report sent to your home address. When you see a company selling something called a credit repair kit, check out the contents before you buy. The previous credit repair information (concerning letter content, etc) is what they are usually selling.
If you are able to achieve results, you are one step closer to bad credit report repair. If the credit bureau does not respond to the follow-up letter, your only real option is to contact an attorney.

Depending on your political colours or the newspaper you
read, the Northern Rock saga could bring down the Brown
government, be the end of the West's global economic hegemony
or cost you your job, GBP3,500 or GBP100bn. Unlucky if it's the
latter.

For our little corner of the City, it's also the Big Story
of the week, and the political intrigue does not end with
Gordon Brown and Alistair Darling. With the bank's fate all
but sealed Linklaters has finally landed a major role on the
Northern Rock deal (see story). As the only magic circle firm
not directly involved with Northern Rock, you could argue it
was a shoo-in for its role advising the new board but it's
good news nonetheless.

Not such good news for Freshfields, it would seem. After
dumping its longest-standing client - the Bank of England -
so it could act for the Rock, it looks like Freshfields'
Northern Rock relationship could be nearing an end. Slaughter
and May will be advising on the bulk of the near-certain
nationalisation so the bank no longer needs advice as a
takeover target.

Still, fees of around GBP10m should ease the pain.

So Pillsbury Winthrop Shaw Pittman has made good on its
pledge to rebuild its shattered London office ?

Well, it's made a start. And it needed to. A succession of
exits had left the firm with just one full-time partner in
the City. The steady drip of exits had become a flood, and
the firm was in real danger of evaporating out of the UK
altogether.

Yesterday two partners, one from Chadbourne & Parke and another
from Wragges, came to the rescue.

Denis Petkovic, the structured finance partner who has
parachuted in from Chadbourne to head Pillsbury's European
and Middle East practice, admitted yesterday that there was,
"an element of risk" attached to his new role.

No kidding. Still, it's a refreshing spin on an old theme.
Partners usually claim they were attracted by the potential
and the global platform (it sure ain't the people in this case
- there aren't any).

Presumably there's a little financial incentive in there too.
Despite the firm's rocky time in London, Pillsbury's global
figures for 2007 - revenue up just 1 per cent per cent to $590m
(GBP299m) and average profit up 12.6 per cent $985,000 (500,000),
show signs of stability if nothing else.

The firm, which merged Pillsbury Winthrop with Shaw Pittman in
2005, has had all sorts of integration issues on both sides of
the Atlantic. Its priority post-merger was to sort out the US
domestic piece. The hire of five partners in New York alone at
the end of 2007 suggests it has made headway, now it has turned
its attention to London and this pair's arrival is evidence of
that.

The firm certainly has ambition but it also has an image problem
and has a long way to go before it puts its problems behind it.

Age Discrimination: What to Do

Medical Accounts Receivable Financing-Stat! explores the unique issues presented to lenders and B2B medical businesses in order to successfully factor medical receivables.
According to the U.S National Library of Medicine and the National Institutes of Health Medline dictionary the word stat is an adverb for the latin word: STATIM. Statim is an adverb that means immediately or without delay. When a persons arrives at the hospital emergency room with a gunshot wound, the staff might say, We need to get this patient to surgery stat! meaning immediately, now. In a medical situation stat connotes extreme urgency. Does your medical business need to accelerate cash flow with accounts receivable financing stat ?
One of the greatest challenges for medical professionals is managing their accounts receivable. Medical accounts receivable typically are the largest asset on their balance sheet. It typically takes 60 to 120 days or more to collect medical accounts receivable because of the long reimbursement process from third party payors, such as Medicare, Medicaid, and commercial insurance companies. The collection process is long and complex. Disputes regarding payment amounts are common. Medical accounts receivable financing accelerates cash flow to pay for expenses such as payroll, malpractice insurance, rent, inventory and advertising.
What are the types of medical professionals that may qualify for medical accounts receivable financing? The following is a partial list: hospitals, medical centers, rehabilitation centers, medical laboratories, surgical centers, sports medicine centers, MRI imaging centers, physical therapy centers, substance abuse clinics, physical therapy centers, manufacturers and/or distributors of medical devices, and physician s practices whether general or specialized from A to Z such as anesthesiologists, gastroenterologists, obstetricians, and Zygote Morula Specialists.
How lengthy is the process to obtain medical accounts receivable? It generally takes four to eight weeks to obtain funding because of the unique issues presented. The commercial finance company must perform extensive audits and analysis of the prospective client s financial situation. They need to determine that the business is and will be a going concern . They need to examine billing practices which often are outsourced. This may require a separate audit of a third party. And they need to examine the forseeability of collection of the outstanding accounts receivable by auditing the accounts receivable aging reports from a historical collection perspective. In other words, how much of the amounts owed will be collection losses? How much will actually be collected?
What are other unique issues regarding medical accounts receivable financing? There are potential bankruptcy issues, lien priority issues and the big bad wolf issue: after a commercial finance company has purchased medical accounts receivable, the federal government can assert lien priority on the assets of a bankrupt medical company. One example of this is the case of American Investment Financial ( AFI ) versus the US also known as the internal revenue service.
AFI loaned over $800,000 to a pediatric and urgent care clinic. The clinic defaulted on their financial obligations to AFI and also defaulted on their tax obligations to the federal government. It was undisputed that AFI had followed the rules correctly in terms of filing their liens and perfecting their security interests. Nevertheless, the court held that pursuant to Federal law, after a 45 day statutory safe harbor period had passed, the government s lien took priority. AFI lost hundreds of thousands of dollars because of federal tax law and IRS regulations. It is no wonder that commercial finance companies look very carefully before they purchase medical accounts receivable.
Commercial finance companies will generally advance an amount equal to 70% to 80% of a borrowing base, which may be called the aggregate amount of eligible accounts , net realized value or net expected collections . You can expect the following items to be excluded from your borrowing base: accounts which are subject to dispute, counterclaim or setoff; accounts of any account debtor who has filed or has filed against it a petition in bankruptcy; accounts owed directly by patients or customers.
The bottom line: medical accounts receivable financing, or medical factoring, is more difficult to obtain than other types of factoring because of the legal risks and business risks faced by the lenders. The process to obtain medical accounts financing usually takes much longer than accounts receivable financing for other industries, such as a manufacturer. This good news is, once the credit facility is established, funding can take place in a day or less from your request for financing. You can have medical accounts receivable financing stat !

when Latham & Watkins and Skadden Arps Slate Meagher & Flom
broke the $2bn revenue barrier for the first time.

Today another US firm followed suit, posting global revenues of
$2.1bn and surpassing Skadden in the process. That firm was

It was way back in the mists of 2003 that Linklaters decided
to really go for it in New York. At that year's partners'
retreat, it was pretty much the only item on the agenda.

Five years on and the firm's US senior partner, Paul Wickes
has just sent what amounts to a love letter to the US market

It seems Links is getting narked by losing out on the US end
of deals. Last year, Shearman & Sterling swooped in for the
US bank regulatory practice end of RBS's multi-billion dollar
acquisition of ABN Amro because the UK-headquartered firm had
no capacity.

Now, as we reveal, the firm is looking to build not just
this area but pull out the stops on its New York M&A practice.
Worldwide, this represents around a third of Linklaters'
business. The firm wants it to be the same level in New York,
but as of today it has slightly fewer than 20 lawyers in its
New York corporate team, just over 10 per cent of the office.
"We want it to be up around 30 per cent," Wickes declares.

Maybe it is only a coincidence that today is Valentine's Day,
but it looks like Linklaters' love affair with the US is going
from strength to strength.

Hammonds has celebrated Valentine's Day with a female-only
shindig at London diamond trader Holts Jewellers.

Clients including Barclays, Lloyds TSB and RBS received
lessons in identifying a real diamond and were then put to
the test. See story.

But such Valentine's shenanigans have been stonewalled by
other firms: "Nothing but a commercial rip-off," cried a
source at Clyde and Co. "Hideous, commercialised nonsense,"
echoed Thompsons Solicitors.

So just as well these lovesick cynics weren't invited to
Freshfields or Linklaters.

If the jelly bean love hearts being distributed to staff
wouldn't cause rumblings in their stomachs, the fountain
in the firms canteen overflowing with gooey, icky chocolate-
flavoured lurve probably would do.

Coming up with daily commentary on the goings on in the
legal profession can be exhausting, so we thought we'd hire
in some help.

Rob Brydon, star of TV shows Marion & Geoff, Oliver Twist
and that one about Napoleon, was the host of The Lawyer's
second HR Awards ceremony, held last night in London's Park
Lane Hilton. His observations have written this script for
us.

Berwin Leighton Paisner had it coming from the off. Even
before the firm's HR team ran away with three of the night's
trophies, the champagne-charged rabble saw Brydon give them
an ASBO for noise pollution. Patrick McCann, the firm's hirsute
head of training, meanwhile, will from this day forth be known
as Beowulf after his awarding-collecting bound saw him compared
to the Anglo-Saxon hero.

Addleshaw Goddard graduate recruitment manager Brett Galloway
was also on the receiving end of Brydon's wit when a particularly
cocksure swagger onstage saw him labelled a "confident young man"
by the comedian. It was a euphemism.

But an ASBO wasn't all that BLP collected. After trooping off
with three awards, Beowulf's smile sparkled as brightly as his
glittering tie.

Story of the day is CMS Cameron McKenna's non-integration
with its CMS allies across the world. See story

Of course, CMS is claiming this to be "closer alignment"
but sources around the network suggest that this latest move
smacks of a political compromise.

The genesis of the CMS plan for integration was when the UK
partners at CMS Cameron McKenna looked enviously at the likes
of DLA Piper and Eversheds and thought we should be more
like that. Then they thought, hang on, we are like that - if
only we could bond properly with our allies.

It was a big if.

Unfortunately their allies didn't want to get that close to
them. While the UK partners wanted a Deloitte-style network
operating under one CMS brand, its allies wanted to remain
independent.

So in the end they voted for "closer alignment", common
procedures and the like.

New CMS executive partner Dick Tyler claims this is the
"evolution" of a 20-year relationship. But the time was ripe
for consummation. And Camerons just couldn't make it happen.

Forget America's Most Smartest Model

The latest reality show taking America by storm is America's
Most Smartest Model. But in the legal market, the talk of
New York is the race to become 'America's Most Biggest Law
Firm'.

Yesterday, The Lawyer exclusively revealed that both Latham
and Skadden had posted turnovers above $2bn (GBP1.03bn) for
the first time. See story.

The results mean Skadden is now neck and neck with Latham,
battling tooth and nail for clients' votes (or their cash
at least) in the bid to be 'America's Most Biggest Law Firm'.

While Skadden is yet to be evicted from its iconic number
one spot, the danger is real. Latham grew an astonishing 23
per cent in revenues while Skadden's 9 per cent increase looks
measly in comparison.

One firm that has been evicted from the race is Jones Day,
where initial estimates suggest revenues are flat. Sidley
Austin and White & Case have muscled their way into the big
five after increasing revenues by 11 per cent and 16 per cent
respectively.

Baker & MacKenzie completes the big five. The firm is an oddity
among these big beasts, not least because its financial year
ends in August, when it reported a $1.82bn turnover.

Those looking for signs that the credit crunch has hit US firms
will have to wait another year.

Why Hire A Personal Injury Attorney?

Before you can make a decision as to whether or not you should hire a personal injury attorney / lawyer, you first have to know what a personal injury case is.
Most people think that a personal injury claim is a car or motor vehicle accident claim. While an injury sustained in an automobile accident where another was at fault would be a personal injury claim, there are many other matters that also fall under that heading.
A personal injury attorney / lawyer handles matters where there has been a personal injury, either physical or emotional, which was caused by the negligence of another. If there was no negligence then there is no case. There must be negligence, whether intentional or unintentional, on the part of another, for a claim to be valid. In other words, you would have trouble making a case against your landlord, where you spilled water on your kitchen floor and then slipped and fell because of the water. However, if the landlord had failed to fix the plumbing under your sink and the water was on the floor because of leaky plumbing then you may, I say may, have a case. There are other variables that could come into play and you would need to seek the advice of a good personal injury attorney, in order to determin your rights.
There are many matters other than car accident matters that can many times be included under personal injury, IE: slips and falls, workplace accidents (after a workplace accident you may be covered under workers compensation or disability but you may also have a personal injury claim), injuries caused during a storm or power outage, airplane, bus and train crashes, construction accidents, fires, food poisoning, drug or vitamin overdoses, animal bites, getting beat up, robbed or otherwise injured inside or outside of a business, medical malpractice and even malpractice by an attorney.
There are many variables that can come into play in determining negligence and many times you may think that there was no negligence on the part of anyone when there actually was. I myself, know of a case where a party was struck by a car while riding a motorcycle and injured severely. He settled with the driver and the driver s insurance company for the $100,000.00 maximum of the driver s insurance policy. This settlement did not even begin to cover his medical bills. Some time later, a personal injury attorney, while speaking with a member of the injured party s family, found about the case and was asked to look into it for the family. The injured party was broke and paralyzed. The attorney did some checking and then agreed that, even though the man had accepted the settlement, there might still be a case. He then hired my detective agency and another to do further research. Finally, he filed a law suit against the car driver, the drivers insurance company, the motorcycle manufacturer and others. I won t go into the whole case, but suffice it to say that he went to trial and ended up obtaining a verdict against several of the parties, including the drivers insurance company and the motorcycle manufacturer, for several million dollars and the injured party is no longer broke. I might add that the attorney took the case on contingency and advanced, out of his own pocket, all of the expenses including court costs and investigation fees.
The point of the foregoing is that if you have been injured, you should seek the advice of a competent personal injury attorney even if you don t think that there is anyone at fault. Only a good experienced personal injury attorney can attempt to make that determination.

as Valentine's Day.

hits the courts today. The soon-to-be former Mrs McCartney

Crossley probably could represent herself in court. She's
now on her fourth divorce from a millionaire.

On Wednesday, her lawyer, Raymond Tooth of Sears Tooth, is
trying to persuade the divorce courts that her estranged
husband, Stuart Crossley, failed to disclose his full
financial wealth when they signed the pre-nuptial agreement.

If Tooth successfully argues that the contract is not binding
because of the disclosure failure then she could scoop an
even bigger slice of his fortune and set an important precedent.

One barrister who probably won't be enjoying a candlelit
dinner on Thursday is 12 King's Bench Walk's Lincoln
Crawford, who has been named as the stalker recorder

Arizona Lemon Laws and the federal Lemon Law (the Magnuson-Moss Warranty Act) provide for compensation to Arizona consumers of defective automobiles and trucks and other vehicles and products including motorcycles, RV s, boats, computers and other consumer products.
If you purchase or lease a vehicle in Arizona and then discover that it has defects that substantially affect its safety, use or value, Arizona Lemon Law may help you gain satisfaction from the vehicle s manufacturer. Under the Arizona Lemon Law, new cars, leased cars, pre-owned cars, RV s, motor homes, motorcycles, boats and other consumer vehicles qualify for protection if they were accompanied by a written warranty. While the law cannot help everyone with a "lemon", and some people may have to hire an attorney to get their cases resolved, the law does create important rights for the consumers.
Circumstances in which the consumers seek protection under Arizona Lemon Law:
A. It is presumed that a reasonable number of attempts have been undertaken to conform a motor vehicle to the applicable express warranties if either: 1. The same nonconformity has been subject to repair four or more times by the manufacturer or its agents or authorized dealers during the shorter of the express warranty term or the period of two years or twenty-four thousand miles following the date of original delivery of the motor vehicle to the consumer, whichever is earlier, but the nonconformity continues to exist. 2. The motor vehicle is out of service by reason of repair for a cumulative total of thirty or more calendar days during the shorter of the express warranty term or the two year period or twenty-four thousand miles, whichever is earlier. B. The term of an express warranty, the two year period and the thirty day period are extended by any period of time during which repair services are not available to the consumer because of any war, invasion, strike, fire, flood or other natural disaster. C. The presumption prescribed in this section does not apply against a manufacturer unless the manufacturer has received prior direct written notification from or on behalf of the consumer of the alleged defect and has had an opportunity to cure the alleged defect.

Differing from some laws in other states, the Arizona Lemon Law allows unsatisfied car buyers to sell the defective vehicle, or to trade it in for a different automobile. To preserve the consumer rights outlined in the Arizona Lemon Law , vehicles with warranty defects offered for sale must be accompanied by a written disclosure that declares the owner is aware of the automobiles defects (a written statement from a professional inspector is better), and the vehicle s manufacturer needs to be notified of the unsatisfied buyer s intention of sale or trade.

This is a small step but could save you big time, as well as enabling authorities to catch a thief with the name of the server who last had possession of your credit card and was out of your sight for a period of time.
You know that junk mail you get almost every day? Much of it has your name and address, but sometimes it also contains very private information such as your date of birth and even your social security number. Don t just throw that in the trash can invest in an inexpensive shredder at an office supply store like Best Buy or Office Depot, and shred that junk mail. Many occurrences of identity theft have come as a result of thieves going through someone s trash and discovering such information in the trash, with more than enough data readily visible to create a temporary new you .

Got Sued? Creditor Law Suits

Often a creditor will try to collect a debt by suing you. If you have any good reasons why you think you don t owe the money, this is the time you must raise them. Why defend a suit if I am "judgment-proof"? It is important that you take action to protect yourself immediately even it you are unemployed, have no money, and believe you have nothing to lose. Some debtors are "judgment-proof". What little property they have is "exempt" from collection under state law. But most debtors don t remain judgment-proof forever. As soon as a debtor gets a job, a creditor with a judgment will be able to "garnish" up to 25% of the debtor s wages to collect the court judgment. If you are sued, you should immediately consult a lawyer who specializes in consumer rights. Your attorney should at least be able to buy some time - and might be able to negotiate a settlement or repayment plan with the creditor. What defenses might I have to a debt collection lawsuit? First, if the debt is pretty old, it might be barred by the "statute of limitations". For example, in California a creditor must file suit on a written contract within four years of breach and on an oral contract within two years of breach. But you might have lost your statute of limitations defense if you have acknowledged the debt in writing after enforcement is barred by the statute of limitations or paid any portion of the debt after enforcement is barred by the statute of limitations. Second, the interest rate on the debt might be "usurious" - in excess of your state s limit on interest rates. Third, you might have made payments on the debt that were not credited to your account. If so, copies of your receipts and cancelled checks can be used to prove your payment. Finally, the property you bought on time might be defective - entitling you to "offset" the debt with the cost of repair. This may be a good defense if the seller made express representations about the quality of the goods that are not true, or even if the seller said nothing - if the goods are not fit for ordinary use or for a specific purpose that the seller knew about. What if I am sued in small claims court? If you are sued in small claims court, you are not allowed to hire a lawyer to represent you at the hearing. If you wish, though, you may consult with a lawyer before the hearing to find out your legal rights. In some communities, there are free small claims court advisors. Call the clerk of the small claims court to find out about this. Here are some more questions and answers: Can I be sued for my spouse s debts? Sometimes. Can I settle a lawsuit by renegotiating my debt? Certainly. There are many types of agreements you might be able to make with your creditors to alleviate your financial problems. For example, if you have temporary financial difficulties, you might ask the creditor to take less than the full monthly payment (perhaps interest only) for a limited period of time. If the size of the payment is a problem, you might be able to arrange with the creditor to reduce the amount of the monthly payment and extend the term of the loan. You could offer to pay a significant portion of the debt now in exchange for forgiveness of the balance. The creditor might feel "a bird in the hand is worth two in the bush". This is especially true when a settlement now allows a collection agency to close its books on a debt, take its percentage as a fee, and stop running up any more expenses for debt collection. When news filtered through that LG was taking a four-lawyer
team from the London office of Dorsey & Whitney, the
immediate reaction was "poor old Dorsey, not another raid",
but that's not really the case this time.

The Minneapolis based firm is the king of the American
Midwest but has suffered a few losses in its offices in
New York and London, with departees complaining about a
lack of internationalism.

But the opposite is true here.

The team's lead partner Jean-Pierre Douglas Henry compared
Dorsey and LG thus: "We're going from a multi-office, US
platform to a tried and tested single office. Which is better,
a globalised law firm or a solid single office with best-
friend law firms? For us it is a vote in favour of the latter."

But the story gets better still. Douglas Henry and co are
moving so they can sue banks and financial institutions.

As Dorsey's London managing partner Paul Klaas says: "Their
plan is simply incompatible with Dorsey's focus."

But not with brave LG, which is now looking to benefit from
any post-credit crunch fallout. Let the battles commence.

public affairs function, as shown by the new lobbying role
created for former company secretary Larry Stone. (see story)

Stone's appointment comes after BT Global Services shifted

Even though its results had been pretty comprehensively
hinted at last month, when Cadwalader Wickersham & Taft
laid off 35 lawyers, it still came as something of a
surprise that the firm took such a bath on its average
profits last year. See story

Cadwalader bet big on capital markets and structured finance.
Until August last year that bet looked a dead cert. Now it
just looks dead.

Yesterday (5 Tuesday), Cadwalader posted average profits of
$2.72m (GBP1.37m), a 6 per cent drop on 2006's $2.9m (GBP1.48m).
The level of underperformance in certain parts of the firm's
practice is evident in the 10 per cent collapse in the
revenue per lawyer figure, down from $1m (GBP500,000) to
$910,000 (GBP455,000).

But let's not get carried away. Any firm in New York that
is posting a PEP above $2m is going to be reasonably
satisfied. For the majority that's still a benchmark too
high. Cadwalader remains far, far above that at $2.72m.
It's just not quite as far above it as it was this time
last year.

It's next year's figures that will really count.

Tony Blair's big brother is now a judge.

For those working in human rights, this phrase may make you
shudder. First we had the 1984-style Ministry of Justice,
now we have Blair's big brother...

But fear not, the news is merely that William Blair QC of 3
Verulam Buildings has been appointed a judge in the Queen's
Bench Division of the High Court. See story

So Blair's brother has beaten Blair's wife, Cherie Booth QC
of Matrix Chambers, to a role on the bench. The pair have
enjoyed similar career trajectories.

Blair became a barrister in 1972, Booth qualified in 1976.
Blair took Silk in 1994, Booth followed suit in 1995. Blair
was appointed a recorder in 1998, Booth in 1999. So with
Blair making the judiciary this year, Booth may not be far
behind.

At this rate, we'll have more Blair allies on the bench than
in the cabinet.

A Guide to Contributory Negligence

If you have been involved in a car or motorcycle accident that has led to a whiplash claim, you might be accused of contributing to the cause of the accident: the correct legal term for this being "contributory negligence". Here we look at the possible causes of contributory negligence and whether it prevents you from making a whiplash claim or other claim for compensation.
What is contributory negligence?
To be able to make a claim for compensation for whiplash you first need to prove that someone else was totally or largely to blame for that accident. The law of tort says that you must prove:
* That someone owed you a duty of care (to drive carefully and not to cause damage to you or your vehicle) * That someone has breached that duty of care (ie they drove into you) * And that driving into you has caused damage, injury or loss (causation)
If they can prove all of these points they can make a claim for compensation. However, that claim for compensation can still be reduced in amount if the other driver can prove that you were partially responsible for the accident. If they can prove that you were 50% responsible for the accident, then your total claim for compensation would be reduced by 50%, meaning that if the total claim was initially for 10,000, it would be reduced to 5,000. There can be a large number of causes of contributory negligence. Monday's news is all about age.

First up, the youngsters.

The College of Law's chief exec, Nigel Savage, today slammed
the Solicitors' Regulation Authority (SRA) for new rules that
he says will exclude certain young lawyers from English practice.

A provision in the SRA-drafted rules on lawyer transfer
dictates that lawyers have to do a year's work supervised by
an English-qualified lawyer.

This makes it easy for legal rookies from western Europe,
Australasia and the US to join Brit firms, Savage says, but
nigh-on impossible for those from, say, China, India or Nigeria.

So serious is Savage about the "disastrous" effect of the
provisions on the UK legal market that he has put Matrix Chambers'
Rabinder Singh QC on the case, who warns that the new rules
could breach both the Race Relations and Competition acts.

And then there are the seniors. Well, 'senior', actually.

SJ Berwin's indefatigable mediation chief, David Shapiro,
today announced today that he has quit the job to go freelance
to avoid conflicts. At the age of 80. See story.

Slip and Fall Injury - Who s to Blame?

When the Occupiers Liability Act of 1957 was passed, it was not only for the cases of slip and fall accidents. It& 39;s main objective is to determine whether a " duty is owed by a person as occupier of premises to persons other than its visitors in terms of the likelihood of their suffering injuries in the basic premises of any risk by the state the premises or things done or omitted to do. "
Furthermore, under this Act, the residents of any premises or has an obligation to take responsibility for these risks. Therefore, it must ensure that the risk is in all conditions, if the slip-and-fall accident case and that he is practically expected to provide necessary protection. Next point is that the people know, or has reason to believe that someone in the area of risk or may come into a dangerous area. This applies regardless of whether or not the person who is in the premises of the residents have legitimate authority to be there or not. Third, the occupying forces has knowledge or reason to believe that a particular area in its premises is dangerous or unsafe.
The law also takes into account a duty of care " ". This is a passage in the said Act states that the " common duty is to make these treatments as in all the circumstances of the case is reasonable to see that the visitor will be reasonably safe in using the Grounds for the purpose for which he is invited or permitted by the occupiers to be ".
In simple words, the Act defines the occupiers as someone who is aware of its responsibility for any negligence or failure to a certain place to ensure the injury to a visitor or passers-by. They know that every visitor must be kept adequately protected from potential slip and fall accidents while on the premises. You have to be certain measures to avoid such accidents.
Meanwhile, landlords, as an occupier of premises, under the Defective Premises Act of 1972. Under this law, the landlord of the premises has an obligation to carry out repairs and maintenance as steps to avoid situations of possible slip and fall. It is clear that landlords have a duty to all the people who have affected by defects in their premises.
However if the residents have reason to believe that the sloppy processing of an independent contractor or some other factors have significant liability or negligence to a slip and fall accident case on his premises, he can order a legal defense. This may be his responsibility to remove a victim, and places the blame on the another.
If slip and fall accident involving children, adequate supply of adults will be questioned. Farms, where the accident took place, such as schools, which will include duties. In slip and fall accident cases, the law is adequate protection for both parties involved in the fixing responsibility for the violation sustained.
