It's the last day of January, and it looked as if nothing
big was going to happen. Let's face it, the news that Mark
Dawkins has been re-elected managing partner of Simmons &
Simmons when nobody stood against him is hardly going to
set the world alight.

Nor was the news that a US firm, Brown, er, Rudnick, decided
it was about time it made some Brits up to its partnership,
10 years after launching in the capital.

No, the biggest news of the day was this: a survey which
reveals that lawyers drink more tea than those in any other
profession, including builders. It's already generating
furious debate on www.thelawyer.com

That lawyers drink so much was surprising. That a Yorkshireman
then admitted that he didn't drink tea at all was astonishing.
(The Yorkshireman in question has begged to remain
anonymous but we can reveal he works in a magic circle firm.)

Meanwhile, a real Yorkshireman, who lives and works in Yorkshire,
comments: "In Yorkshire anything less than 10 cups per day

Freshfields Bruckhaus Deringer's press shindig went off in
fine style last night, held in the panoramic splendour of
the 29th floor of London's Millbank Tower.

That's right, the old Labour Party HQ.

Less champagne socialism, more plain champagne, the event
did nonetheless have a certain New Labour, 1997-kind of feel.
There were plenty of people in suits feeling pleased with
themselves, for a start.

Factor in the DJ and saxophonist, late-90s trip hop-style mood
music and you've got a little bit of Cool Britannia in there
too.

And then of course there was the keynote speech by joint
senior partner Guy Morton.

All very moral, the speech heralded what the firm says is
a unique, externally-assured commitment to corporate social
responsibility covering everything from conflicts to diversity,
climate change and pro bono; and which not unreasonably implied
makes them a far nicer bunch than their nasty-party opposition.

Of course, one key difference between New Labour and
Freshfields did stand out. Unlike Tony Blair and Gordon
Brown, Guy Morton and Konstantin Mettenheimer have always

OK, OK we'll get to the point: DLA Piper has launched a
Facebook-style networking site for future trainees. See story.

For those unfamiliar with such Generation-Y concepts, Facebook
is an online phenomenon in which teenagers and David Cameron
trade esoteric salutations, photos and gossip, and is quite
the latest thing in parental bemusement and peer humiliation.

Keen to ride the wave, DLA's own social networking site,
"Inside the Tent", allows future trainees to spend time
getting to know the colleagues with whom they are shortly
to spend their dwindling youth.

Not all fun and games, however, it also allows DLA's graduate
recruitment team to communicate more easily with its future
proteges, and to boost its green credentials by dispensing
with the need for paper-based mail-shots.

Whether DLA's in-house Facebook banter will be quite as
irreverent as the real thing is anyone's guess.

But as former US president Lyndon Johnson might have put it,
it's better to have them inside the tent p***ing out than
outside the tent p***ing in.

A quick glance at last week's completed M&A deals sees Carlsberg
and Heineken's joint acquisition of Scottish & Newcastle (S&N)
towering over the rest, which are, frankly, rather small in
comparison.

The saga has kept Linklaters' Matthew Middleditch busy
throughout this early credit crunch period as the S&N team
manfully wangled another GBP700m for shareholders. See story.

The next biggest deal to complete last week was the GBP135m
acquisition of a bunch of Portuguese resorts by UK hoteliers
JJW, which was advised by CMS Cameron McKenna. After that,
Olswang and Withers worked on the sale of a minority stake in
Soho House for about GBP100m, and then you had a series of sub-
GBP100m deals.

Mid-market firms have been claiming little concern about the
credit crunch, as it will only hit big private equity deals,
they claim. But on last week's evidence they ought to be afraid.

It was difficult to get excited about today's news that
Clifford Chance will launch in Abu Dhabi. There have been
so many Middle East launches of late. See story. But it is
more evidence of firms looking to new jurisdictions in a bid
to find a warmer economic climate. Expect others to follow suit.

The appointment of Chris Saul as Slaughter and May's
senior partner has set tongues wagging in the legal market.
Not least when he declared in his first interview as managing

Ever get the feeling you're living in the '80s?

The markets have gone nuts, there's a war in Afghanistan
and, more importantly, insider trading and negligence have
made a comeback (allegedly). It's like the movie Wall Street
all over again.

Barely a week after the resignation of Berwin Leighton Paisner
real estate star Vinay Veneik, former TTP Communications and
Thomas Cook general counsel Christopher McQuoid appeared in
court charged with insider trading. (see story)

He has been accused of profiting from insider information by
buying shares in TTP before its merger with Motorola. He pleaded
not guilty.

McQuoid appeared with his father-in-law, James William
Melbourne. Presumably Michael Douglas will play that role when
the film version comes out.

The only thing that's missing from this picture is a return
to power suits, huge shoulderpads and dodgy mullets.

How many senior lawyers can you get in a room? Hundreds, if
it's a cold night in January.

There was plenty of laughter and glass-chinking at The Lawyer's
Hot 100 party at the Royal Exchange last night, but also some
serious talk about where the market was going. The private equity
partners looked particularly gloomy and the banking partners
came early and stayed late.

One of the nicest moments was when Clifford Chance's senior
partner Stuart Popham congratulated Chris Saul on his accession
to the same role at Slaughter and May. Popham dropped in following
his Asia jaunt with Gordon Brown and had to leave the party for
a flight to Davos.

Ever the gentleman, Popham found time to give Saul a couple of
handy hints on the top job, none of them concerning the dangers
of deep vein thrombosis.

But the question we're all asking is this. Which magic circle
partner got an almighty slap in the face from a frisky silver
circler? And which general counsel was last seen surfing down
the stairs? Sod the credit crunch, eh?

There are some bright, young things on this year's silks
list including Essex Court duo Alan Lowe and Toby Landau
and Four New Square's Graeme McPherson, who were called to
the bar in 1993.

But one new QC has a bit more experience. He was called in
1971 and 37 years on, Brian Lett of 2 Paper Buildings has
made it...actually that should be Brian Lett QC.

Lett is the longest serving barrister to get the nod on today's
silk list. But why did he finally decide to apply for the
prestigious accolade so far into his career?

Lett said: "Having done silk work for years it just seems
sensible. Why not have the kudos if you do the work?"

Quite right.

"I reached around 20 years call while at Three King's Bench
Walk, now QEB Hollis Whiteman, when I was told that I could
be considered for silk but for family reasons my wife and I
decided that we should move to the west country," explained
Lett.

His move to Taunton, where he set up his own chambers, put
paid to his ambition of becoming a silk. "But after 10 years
on the Western circuit and most of the kids gone we thought
it was time to come back to the City," Lett continued.

That was just over four years ago and having re-planted his
flag firmly in London, Lett has got his hands on that coveted
kite-mark.

Finally, a month later than expected, this year's list of
new QCs will be released officially tomorrow. We've had a
sneak preview but we're sworn to secrecy.

We can tell you that today, 333 barristers have received
letters through the post informing them whether or not they
have received the royal stamp of approval on their careers
to date.

Last time round, barristers and clerks celebrated a bumper
crop of 175 because of the three-year gap while the Department
of Constitutional Affairs (RIP) got its act together. This
year that's been normalised.

Around 100 barristers will be taking silk, not on Maundy
Thursday, which falls on 20 March this year, but on 28 March.
Perhaps that too can be normalised next year.

So who are the newbies on silk street? We'll have it on the
site for you first thing in the morning.

The real estate sector is still reeling with the news of
BLP partner Vinay Veneik's shock resignation, over allegations
that he covered up mistakes he had made on deals. See story

Veneik, who had built up a glittering 16-year career working
with clients such as Great Portland Estates and Legal & General,
was known as a talented and aggressive deal-maker.

Former colleagues expressed surprise over BLP's claims that
he had omitted to pay stamp duty and register the transfer of
property.

It is astonishing that BLP has released this story and even
more astonishing that Veneik would give his consent, which
according to BLP's spinmeisters, he has.

But with the real estate market entering what may be a
prolonged slump, perhaps Veneik just thought it was time to
put his feet up.

With the bulk of the UK's working population, male and female,
now facing a retirement age of 68, all most of us have to look
forward to is decades more of near-endless graft.

Not so for those Clifford Chance partners lucky enough to
have been made up before October 2005.

Spurred into action by the post-Bloxham era, the firm has
revamped its early retirement annuity package, effectively
paving the way for far greater numbers of partners to claim

Clearly there are issues with a system designed to get
partners out the door as soon as a smattering of grey hair
begins to resemble a crown. But removing the reference to
age opens up a world of opportunity to those seeking a
seriously early exit.

Effectively, with partners now able to retire after 15 years
in the position, the new terms could see some bidding their
farewells in their early to mid 40s. Which would leave time
to embark on a whole new 25-year career so that they can
retire at the same age as the rest of us.

Soon hordes of lawyers will roam the City's streets after
dark and clog up the Underground (that's a big tunnel with
a train in), trying to find their way home. The time-honoured
perk of a free taxi home is under attack from those pesky
Revenue bureaucrats.

The cost of late-night cabs to whisk you home could spiral
by up to 67 per cent under new guidelines drawn up by HMRC.

Normally extrovert tax partners clammed up at mention of the
reforms. One just muttered darkly: "I would rather not get
dragged into this."

Another said: "You can't even quote me off the record."

And another partner slipped into a wild rant: "The rules
allow fat, middle aged MPs to get tax-free taxis home at
any time of the evening."

We're not sure of the accuracy of this comment and we haven't
verified whether slim, young MPs are being taxed, but you can
get a flavour of the emotions this story is stirring.

At the end of the night, however, the ones likely most hit by
the new guidance will be partners. It is most likely that
they will let the tax bullet bite their wallet rather than
risk the wrath of disgruntled staff.

Shame. Could have been a good way to reduce that nasty carbon
footprint.

The last 24 hours have been what we call a busy news day.

Late last night, news reached us that Clifford Chance was
on the verge of announcing the arrival of the EC's top
lawyer Michel Petite. That's a coup in anyone's books but,
despite his vast experience, when bagging a top official
there's no guarantee he'll adapt to private practice. He
certainly won't be bringing a book of business and, of
course, now he'll have to defend companies rather than
attack them.

Ashurst was next up with its new management committee. Not
the hugest shake-up if truth be told but the firm's
constitution says it needs one more foreigner on the board
and Reinhard Eyring got the nod. He's an arch-loyalist, who
has been at the firm almost since it opened in Germany. The
other addition was litigation partner Ben Tidswell, who
according to a source is "a bloody good chap". How very
Ashurst.

A&O was also active in Germany, raiding Shearman for its
colourful global head of M&A Hans Rolf Koerfer, who left
Oppenhoff & Radler in 2000 on the eve of its merger with
Linklaters. Upon his departure Koerfer branded Linklaters'
morale miserable, adding that the firm stifles creativity
by relying on its database of precedents and armies of junior
lawyers. He must be one of those artistic, temperamental
types. So no management issues for A&O, which has never
relied on armies of junior lawyers. No sirree.

And just in, the credit crunch has finally taken its first
big bite. Over in NYC, Cadwalader has made 35 redundancies.

Even the most unlikely of organisations can get diversity.
Just ask the police.

A few years ago the boys in blue were unlikely to be considered
the most gay-friendly employers in the UK. Yet in gay rights
group Stonewall's annual ranking of the nation's most gay-
friendly employers published today, the Hampshire and
Staffordshire police forces hold joint third place. Hats
off to them for progress.

When it comes to the diversity, policemen beat lawyers hands
down.

However, Pinsent Masons is leading a change. The firm just
bagged Stonewall's "Most Improved" award, which recognises
the progress the firm has made in pursuing greater inclusivity.

But Pinsents is the only law firm with a place in the top 100,
and even that at a modest 67th place.

Pinsents property head Adrian Barlow observed: "Captains of
industry are no longer prepared to work with people who don't
share their corporate values."

That's not just a snappy soundbite. BT, Credit Suisse, Goldman
Sachs and IBM represent a tiny sample of potentially lucrative
clients that sit higher up Stonewall's charts than Pinsents.
It's not just Barclays and JP Morgan banging the diversity drum
then.

It's like Glastonbury for the bar. Sort of.

Middle and Inner Temples are celebrating 400 years of
independence this year, and it's an excellent excuse for a
year-long festival.

The Lawyer got a sneak preview today of what's in store over
2008. Eclectic doesn't come close. There are events ranging
from debates on law and Islam to choral concerts and organ
recitals - including an organ improvisation to a showing of
1922 horror flick Nosferatu.

The connection? Bram Stoker was a member of Inner Temple
(yes, the jokes just write themselves).

Denied in Full: Federal Judges Grill CIA Lawyers on JFK Secrecy

Lawyers for the Central Intelligence Agency faced pointed questions in a federal court hearing Monday morning about the agency's efforts to block disclosure of long-secret records about the assassination of President John F. Kennedy.Three appellate judges probed for explanations of the agency's rationale for withholding records concerning a deceased undercover CIA officer named George Joannides whose role in the events of 1963 remains unexplained.For the past three and a half years, CIA has blocked the release of the Joannides files, denying my Freedom of Information Act (FOIA) request and spurning scholarly appeals for full disclosure. At stake is the viability of the 1992 JFK Assassination Records Act, which mandates the immediate review, and release of all government records related to Kennedy's murder in Dallas on November 22, 1963. One of the strongest open government measures ever enacted, the future of the JFK Act is now in question as the CIA seeks judicial permission to defy its provisions.

The Year-End Legal Landscape: Leaders, Losers, and Loopholes

Wow. What a year we've had.

We saw the beginning of round two of the O.J. media circus, Anna Nicole's death turned into a kangaroo court, Britney and Paris slammed, Michael Vick went in the slammer, another Peterson missing wife mystery, the Duke lacrosse players were vindicated, their prosecutor went to jail and the Natalee Holloway story was deemed a cold case.

I needed the holidays just to catch my breath, and gear up for the brewing legal stories of 2008.

But before I sign off on 2007, I hope you'll indulge my musings. For example, what should I have told my 10-year-old daughter when she asked, "Mom, why is Anna Nicole Smith so famous … what did she do?"

Ana's case regarding her husband's estate made it all the way to the Supreme Court, but that's not how she'll be remembered. And what can I say (politely) about the judge who cried while presiding over the issue of where her body should be buried. (He reportedly has quit the bench and is being wooed by TV executives.)

Britney, Paris, Lindsay ... where have all our girls' heroines gone? Hasn't anyone ever told them about those nasty little drunk driving laws? Tip to that trio: you violate the law and that's not so "hot." What, again, do I tell my 10 year old about Britney's sis's upcoming "event."

And, it's deja vu all over again ... he's back: OJ. He's older (so are we all) ... but seemingly no wiser. I guess he really just wanted his stuff back. Maybe he should have just stayed on the golf course (or kept up the search for Nicole's killer).

To Michael Vick, I'd say killing defenseless dogs is not my idea of a macho man kind of thing to do. And, yes, you should apologize to all the kids who once looked up to you. Speaking of apologizes, I don't think we ever really heard one from prosecutor Mike Nifong who may have set rape cases back 100 years.

Enough bah humbuging from me ... let's do an abbreviated recap of the year:

O.J. Simpson

• September 13: The Goldman family, having been awarded the rights to the never distributed book, publishes it under the title, "If I did It: The Confessions of the Killer."

• September 14: "If I Did It" is published the same day news first breaks that Simpson had been questioned by police in connection with an alleged holdup in Las Vegas. Police name O.J. as a suspect in the case.

• September 16: O.J. is arrested.

• September 17: Audiotape is released of a sports memorabilia dispute involving O.J. in a Las Vegas hotel.

• September 19: A judge sets $125,000 bail for Simpson, who posts bond, is released from jail and returns home to Florida.

• October 15: Charles Cashmore and Walter Alexander, co-defendants in the armed robbery case against Simpson, take plea deals in Las Vegas. They agree to plead guilty to a felony and testify for the prosecution.

• November 2: According to FBI reports obtained by the Associated Press, federal agents learned three weeks in advance that Simpson and Thomas Riccio planned the operation to retrieve personal items Simpson said were stolen from him.

• November 14: A justice of the peace ruled O.J. must face trial on kidnapping, armed robbery and other charges stemming from the memorabilia heist.

• November 28: O.J. Simpson pleads not guilty to kidnapping and armed-robbery charges.

Michael Vick

• April 25-26: During a raid at a Surry County home, owned by Vick, officials discover evidence that the home is part of a dogfighting operation. With a second search warrant, officials confiscate 66 dogs, 55 of them pit bulls, and equipment that includes a rape stand, pry bar, treadmill and a bloodied piece of carpet.

April 27: Vick claims he's never at the house in Surry County, and blames family members for taking advantage of his generosity.

May 27: Informant tells ESPN that Vick is "one of the heavyweights" in dogfighting dating back to his college days.

• June 7: Officials with the Department of Agriculture execute a search warrant at Vick's Surry County property with the help of state police, finding remains of seven dogs and taking DNA samples. Vick cites a "scheduling conflict" in announcing that his youth camp at Christopher Newport University is cancelled.

August 17: Two of Vick's co-defendants enter guilty pleas, leaving the Atlanta Falcons quarterback on his own to cut a deal or face trial on federal charges. With his NFL career in jeopardy and a superseding indictment adding more charges in the works, Vick and his lawyers are talking with federal prosecutors about a possible plea agreement.

August 27: Michael Vick formally entered his guilty plea to a federal dog fighting charge before U.S. District Judge Henry E. Hudson.

• December 10: Vick is sentenced to 23 months in prison for his role in a dogfighting conspiracy that involved gambling and killing pit bulls.

Britney Spears

• January: Britney is carried by bodyguards out of the nightclub Pure in Caesar's Palace, Las Vegas, after reportedly collapsing. Bodyguards shine lights in club goers' eyes as they leave, so nobody can take photos. Britney is photographed wearing a bikini belonging to a New York club dancer she's swapped clothing with.

• February 16: After 24 hours at a rehab center in Antigua, Britney flies back to L.A. and shaves her hair off. Afterward, she visits a tattoo parlor, where she has a pair of red and pink lips inked onto her wrist.

• July 19: Spears had a meltdown at an OK! Magazine shoot, let her dog soil a dress, wiped fried chicken smeared hands on a couture dress and left early, taking tens of thousands of dollars worth of merchandise with her.

• July 20: Spears went boating with her children, without putting them in life vests.

• July 30: Divorce is official. Spears' lawyer asked that details of the child custody arrangements remain sealed from public view, citing media attention and the possibility of "criminals who might target the minor children for financial gain."

• September 9: Spears allegedly was "inconsolable" after watching her widely criticized comeback performance at the MTV Video Music Awards.

• September 18: Spears' former bodyguard, Tony Barretto, was turned away from Family Court after offering to testify in Spears' custody battle. Barretto apparently became concerned for the children's safety and well-being under Spears' care.

September 21: Spears was charged with misdemeanor hit-and-run and driving a vehicle without a license.

• October 1: Spears lost custody of her two sons.

• October 19: Spears loses visitation rights of her sons.

• October 20: Spears apparently ran over a photographer's foot with her car.

• December 6: Child welfare investigators are looking into "multiple child abuse and neglect" allegations in the custody battle between Spears and her ex-husband, Kevin Federline.

• December 18: Jamie Lynn Spears, Britney's sister, says she's pregnant.

Paris Hilton

• January 15: Hilton (already charged with driving under the influence) is pulled over by the California patrol and informed her license is suspended. She signs a document acknowledging she is not allowed to drive.

• January 22: Hilton pleads no contest to a reduced charge of alcohol-related reckless driving. She is placed on three years probation.

• February 27: Hilton is ticketed for misdemeanor driving with a suspended license. A copy of the document signed January 15 is found in her glove department.

• May 4: Judge Michael Sauer sentences Hilton to 45 days in jail.

• June 3: Hilton reports to jail saying she's ready to serve her sentence.

• June 7: Hilton is released from jail because of an undisclosed medical problem and is ordered to serve the rest of her sentence in home confinement.

• July 27: Hilton puts her 1926 Spanish-style house on the market for $4.25 million.

• September: Hilton sues over the use of her picture and the catchphrase "That's Hot" on a greeting card.

• October: Paris Hilton's charity mission to Rwanda is cancelled.

Drew Peterson

• October 26: Stacy Peterson told her husband she wanted a divorce (according to her aunt).

• October 27: Stacy Peterson reportedly told her aunt she feared for her life.

• Ocober 28: Stacy Peterson, 23, was last seen dressed in a red jogging suit at about 10 a.m. by her husband. Stacy never arrived at a friend's house she was supposed to help paint

• October 31: Drew Peterson told reporters he believes his wife is alive, and said he is being treated unfairly.

• November 1: Illinois State police execute a search warrant at the Peterson home.

• November 3: Dozens of people comb a forest near Peterson's home looking for any traces of the 23 year old.

• November 7: Summoned before a grand jury, Drew Peterson answers virtually no questions put to him.

• November 9: Drew Peterson officially becomes a suspect in Stacy's disappearance. Hours earlier, a judge ordered the body of Peterson's third wife, Kathleen Savio, exhumed so investigators could re-examine her mysterious 2004 bathtub death — which prosecutors now see as a murder, not an accident.

• November 14: Drew Peterson appeared on NBC's "Today" show and said that Stacy had asked him for a divorce — but he thought that was due to hormones.

• December 1: Illinois police say a man believed to be Drew Peterson asked two truck drivers to take a package to an undisclosed location the day after Stacy disappeared.

• December 13: One of Drew Peterson's adult sons appeared before a grand jury investigating the Stacy's disappearance and the mysterious drowning of Kathleen Savio.

When a couple is filing for divorce, but the divorce decree has not been finalized yet, they can still file a joint tax return. Once the divorce goes through, an ex-spouse can file the return as a head of household, if he or she has paid for over half the maintenance of the house and has a dependent living at their home for over half the year.When two parents are divorced, only one of them can claim the $3300 dependency exemption for each child on their tax returns for 2006. The parent claiming the dependency exemption is also allowed a $1,000-per-child tax credit for children younger than 17 as long as their income is not above a certain figure.Usually, it is the person named as the custodial parent in the child custody portion of the divorce decree that is allowed to claim the child as a dependent. If the divorce decree does not name a custodial parent, then the parent with whom the child has lived with the longest throughout the year is the custodial parent.A non-custodial parent, however, can claim the exemption as long as the custodial parent signs a waiver promising not to claim the exemption.If a non-custodial parent claims the exemption first and without the custodial parent’s permission, he or she could be given the exemption temporarily. However, once the custodial parent files the exemption and the IRS notices that a child’s social security number has been entered by two different taxpayers, then the tie-breaker rule would apply. This rule says that if two parents claim that a child is their dependent, the parent that the child lived with the longest during the year would get to claim the exemption. If the child had spent the same amount of time with both parents, then the parent that had the higher adjusted gross income would get the exemption. The parent who “wrongly” claimed the exemption would have to repay the tax, plus penalties and interest.Regardless of who the custodial parent is, if the non-custodial parent pays for any of the child’s medical bills, these costs can be a deduction. Child-care credit for work-related expenses can be claimed for children younger than 13.The spouse who pays alimony/spousal support can also receive a tax deduction for these payments, even if they aren’t itemized—along as the payment amounts are stated in the divorce agreement and made in cash. The spouse who receives the alimony must pay taxes on them. For child support, however, there is no deduction for paying them and no taxes paid by the recipient parent.Assets transferred from one spouse to another during a divorce are not taxed. Finding the Right Lawyer for Your Startup Company

Entrepreneurs tend to stumble upon their lawyers rather than systematically seek out the right lawyer(s) for their company. In the early stages, founders are focused on the products and the customers and often hire anyone who seems vaguely trust-worthy and available and not too expensive to create their initial corporate documents.Once inertia has set in, the entrepreneur just tends to throw anything legal to the lawyer assuming one legal thing is just like the other. This assumption can lead to expensive and disastrous results.Attorneys tend to specialize in certain areas: real estate, employment & labor, corporate & business, arbitration, taxes, contracts, etc. If you hire a corporate generalist who is great at setting up the corporation and creating your corporate documents, you might think this person has the knowledge to write your employee handbook. Don’t count on it.When you are seeking your general corporate attorney, spend as much time comparison shopping as you would with any other vendor. Interview the attorney, understand their working and billing structure. Ask to meet any associates that you might be working with (often these folks are the ones doing the bulk of the work).Most importantly, ask about other specialties in the firm and your ability to work with other attorneys in the firm. The reason that attorneys cluster together in firms is so you can get one stop shopping at the firm, but don’t settle for one stop shopping at your primary contact.If you are required to have all of your contact through that attorney, you may end up doubling up on fees. Let’s say your general counsel costs $350 per hour and the HR specialist costs $350 per hour. * You spend a 1/2 hour explaining your problem to your general counsel ($175), * who spends a 1/2 hour explaining it to the HR specialist ($350 - 1/2 hour each) * who spends a 1/2 hour working on it ($175) and * follows up with a 1/2 hour explanation to your attorney ($350) * who gives you the answer ($175).Then you get a bill for $1225. If you had been able to call the HR specialist directly, it would only cost you $700. Big difference.Also, don’t feel wedded to one firm. If you like your general counsel, but think the real estate lawyer is a jerk, find another real estate lawyer you like.The best way to find an attorney, of course, is a referral. The best referral comes from other companies who have similar businesses to your own.Be aware when receiving referrals from incubators and government agencies that the lawyers who they recommend may have some tie to the organization, such as they offer some free legal advice to incubator companies. This is certainly a legitimate marketing strategy on the lawyers’ part, but it doesn’t necessarily mean that the recommendation you get is for someone good.Finally, if you don’t feel that you are getting your money’s worth from your lawyer, find another one. They are in business as well and should work hard to make sure that you are getting the best service possible. If they are not providing it, they should not be surprised that you

‘Loony’ Lawyer in a Bronx CourtroomVictor Martinez wanted a new lawyer, but he got the boot instead - from his public defender - right in the seat of his pants.Defense lawyer Mark Brenner allegedly kicked Martinez at least twice in a Bronx courtroom after the suspect tried to fire him and wondered aloud if Brenner “smokes crack,” court transcripts and an affidavit indicated.Brenner - derided last year in a fellow public defender’s book as “incompetent, unprofessional and unethical” - then delivered his court-appointed kick, according to an affidavit from Martinez.“Mr. Brenner, come on,” Supreme Court Justice Troy Webber says in the transcript. “What’s wrong with you?”Martinez, who was handcuffed at the May 2004 hearing, interrupted: “Judge, I would like to file assault charges against this maniac.”No criminal charges were ever filed. Brenner is barred from taking any court-appointed work while a professional review board investigates the reported swift kick.Brenner’s lawyer, Larry Sheehan, denied the incident ever occurred and noted that his client was cleared by a grievance committee shortly after Martinez’s day in court.Former Bronx Public Defender David Feige immortalized the infamous kick in his legal memoir “Indefensible” last year.“Brenner is so loony that he once hauled off and kicked a client right in the middle of Troy Webber’s courtroom,” Feige wrote.He ripped Brenner’s courtroom work and maligned the lawyer’s hairstyle as “something that appropriated the worst qualities of both a mullet and a ponytail.”Brenner has since sued Feige, although Martinez held a similarly low opinion of his lawyer.“I think the man smokes crack,” the assault suspect told Webber.The new investigation was launched by a board that monitors court-appointed lawyers after a fellow public defender recently complained to the watchdog group about Brenner, Sheehan said.A transcript of the May 2004 proceeding was attached to the letter of complaint.While the transcript couldn’t record the kick, it did detail Brenner’s other bizarre behavior: Tearing up his client’s written appeal for a new lawyer, challenging Martinez to a fight and providing his pointed take on American jurisprudence.“This is the way the law works in this country,” Brenner told his client. “It’s different than Cuba. The maker of open-source file systems has pleaded not guilty, maintaining his wife abandoned her children and moved to Russia, where the couple met nearly a decade ago.The authorities have suggested Reiser, 43, possibly moved Nina Reiser's body in his tiny Honda CRX. A week after the random traffic stop, Oakland authorities discovered the vehicle drenched on the inside with the passenger seat missing. Authorities said inside the car they found a trace amount of the 31-year-old woman's blood on a sleeping bag cover.The officer, Sgt. Eric Stasiak of the Redwood City Police Department, said the vehicle looked like the defendant was living in it. The passenger seat, he said, was in the car. The defendant's attorney claims the husband at one point removed the seat and discarded it in a dumpster to make way for the defendant to live in the 1988 vehicle.

Stop the Killings: A Short StoryFor quite some time now, I have been looking to write articles in a new genre. Stories about the pathos of boxing and articles dealing with issues of individual freedom are great, but at some point there is a need to see if I can really be more versatile...to see if I can actualize that idea that has been ensconced in my brain for so long. Well, that time came and I decided to do a piece that either involved a spree killer or a mass murderer. Sooner or later, I'd work my way to a serial killer, but first things first.I reside in northern New Hampshire which is adjacent to central Maine so where else could rural poverty, unemployment, and despair engender enough rage and anger to trigger spur-of-the-moment murders? Maybe West Virginia or Mississippi, but for my fictional purposes, the northeast is just fine. Thusly prepared, I began to map out plots and fill in gaps. As a factual backdrop, there were two stories in particular that haunted me and, I believed, would provide a solid conceptual platform for my new fictional pursuits.One involved Andrew Cunanan, a real-life American Psycho who murdered five people, including famed fashion designer Gianni Versace, in a cross-country spree killing journey during a frightening 3-month period in 1997. Among other "colorful" things, he was called a crack head, brilliant child, male prostitute, clever cross dresser, aging kept boy, S&M porn star, and chameleon.

Fake Steve Jobs threatened by Apple Lawyers

Another update. Now they are really pissed. Just got another PDF letter from the same Rambo attorney (photo above; but I won't print his name) saying that in response to my last post about doing things transparently he wants to remind me that while this "course of action" is of course mine to take, he feels it is his duty to inform me that Apple's lawyers have identified at least three posts in my archive that they "deem to be actionable." He says Apple hopes this can be a "conversation rather than a confrontation" [isn't Johnnie Cochran dead? ed.] and that before I turn this into a public fight by continuing on my current "course of action" I should perhaps consider the potentially serious consequences to myself and my family of doing so.This is followed by a recommendation that I retain an attorney to represent me. And then, I swear to friggin God, there's a list of my assets with an estimated value for each and I suppose the implied threat that I stand to lose them. Which kinda scares the living shit out of me, to be honest, since they've got a pretty thorough list, which means they've been doing some research on this and the offer didn't just come out of thin air. Their lists includes my home address, most recent assessed value of my house and all the information about my mortgage; a rental property that we own; my bank accounts and investment accounts, including the college funds for our kids, whose names are used; and our boat and two cars.Damn. And right at Christmas. I am going to go make myself a drink.
